Can I build on rustic land in Amares?

Uses and land classes
O regulamento divide o concelho por tipos de zonas e indica que usos são dominantes, complementares ou compatíveis em cada uma. Aqui estão os usos mais relevantes para quem compra ou quer construir.
Building capacity and parameters
O regulamento define quanto e como se pode construir em diferentes zonas: índices, número de pisos e limites de altura e implantação. Aqui estão os pontos práticos que interessam a um comprador ou promotor.
- Aglomerados rurais — regras — Em aglomerados rurais o índice de utilização (IU) máximo é 0,60 — isto significa que se pode construir cerca de 60% da área do terreno — com máximo de 2 pisos acima da soleira e fachada até cerca de 9 m, salvo condicionamentos locais.(art. 13)
- Habitação em solo rústico — Para habitação no solo rústico há regras específicas: por exemplo, edifícios destinados a habitação podem ter até 2 fogos por edifício e devem cumprir as regras locais de edificabilidade aplicáveis.(art. 38)
- Implantação e impermeabilização — Há limites à área de implantação e à impermeabilização do solo: em muitas zonas a impermeabilização não deve exceder percentagens fixas (ex.: 70–80% em urbano, 60% em baixa densidade), e a implantação cumpre percentagens máximas.(art. 20)
Constraints and easements
Além das regras de uso e edificabilidade, o PDM lista condicionantes que podem impedir ou limitar obras: ambientais, patrimoniais, de risco e servidões. São factores que podem obrigar a procedimentos adicionais ou a impedir construções.
- Rede Natura e zonas protegidas — Áreas integradas na Rede Natura 2000 (ZEC/PTCON0001) e outras categorias ambientais têm condicionamentos específicos: obras só são admitidas se compatíveis com a conservação das espécies e habitats e com as orientações setoriais.(art. 22)
- Floresta e prevenção de incêndios — No solo rústico há condicionamentos ligados à gestão florestal e à defesa contra incêndios (APPS, zonas prioritárias), que podem limitar loteamentos e edificações e impor afastamentos e medidas cautelares.(art. 21)
- Património arqueológico e edificado — Há uma lista extensa de bens arqueológicos e edificados protegidos (património integrado no anexo) que condicionam obras e exigem salvaguardas e pareceres específicos quando a intervenção afeta esses locais.
Procedures and execution
O PDM descreve que várias intervenções exigem planos, autorizações ou pareceres específicos; alguns processos passam pela Câmara, outros pela Assembleia ou por entidades ambientais.
- Planos e UOPG — Áreas identificadas como UOPG (unidades operativas de planeamento e gestão) exigem planos de urbanização ou de pormenor e prazos de execução; sem esses planos a execução pode estar condicionada ou suspensa.(art. 85; art. 86)
- Reclassificação de solo — A reclassificação de solo rústico para urbano é um procedimento próprio, que pode ser considerado de interesse estratégico e exige apreciação pública, pareceres e avaliação (incluindo, quando aplicável, Avaliação Ambiental Estratégica).(art. 6)
- Licenças e comunicações — Obras e uses dependem de informação prévia, pedido de licença, comunicação prévia ou licença de utilização conforme a lei; a Câmara pode exigir pareceres e condições complementares antes de autorizar.(art. 15; art. 16)
- Execução e perequação — A execução do Plano pode ser sistemática (unidades de execução) ou não sistemática; existem mecanismos de perequação compensatória (cedências, fundos e contrapartidas) para repartir encargos e benefícios entre proprietários e Município.(art. 87; art. 97)
