Can I build on rustic land in Aveiro?

About 74% of the territory of Aveiro is rustic land. That does not mean one may never build, but new housing is as a rule tightly restricted and often prohibited unless the PDM makes an exception (rural settlement, a farmhouse, reconstruction). RAN, REN, protected areas, flood zones or rural fire hazard can still block what the plan would admit.   • O território divide-se em Solo Rústico e Solo Urbano, com categorias e subcategorias detalhadas na Planta de Ordenamento.(art. 38)
  • Definem-se termos técnicos como colmatação, corpo balançado, estruturas leves amovíveis, frente urbana, pólos de geração de deslocações, profundidade, varanda e via habilitante para efeitos de aplicação do Regulamento.(art. 5)

Servidões, restrições e áreas protegidas representadas na Planta de Condicionantes que condicionam usos e intervenções no território.

  • São observadas servidões administrativas e restrições de utilidade pública, incluindo recursos hídricos (domínio público hídrico, lagoas, perímetros de proteção de captações), zonas inundáveis e zonas inundáveis protegidas por sistema de eclusa e comportas.(art. 6; art. 8)
  • Incluem-se condicionantes relativas à RAN, REN, aproveitamentos hidroagrícolas, povoamentos florestais percorridos por incêndios, perigosidade de incêndio rural, áreas protegidas e Rede Natura 2000, com condicionamentos específicos e necessidade de parecer da autoridade de conservação quando aplicável.(art. 6; art. 10; art. 9)
  • Património cultural classificado e zonas de proteção prevalecem conforme diplomas de classificação, com intervenções condicionadas à tutela e salvaguardas específicas.(art. 11)
  • Em áreas de risco de cheias o regulamento exige estudos técnicos e impõe interdições (ex.: lixeiras, armazenagem de materiais perigosos, certas construções sensíveis) e regras distintas consoante proteção por eclusas e comportas.(art. 8)
  • A Estrutura Ecológica Municipal integra Espaços Naturais, Verdes, Agrícolas e Florestais, impondo proibições como artificialização de linhas de drenagem e corte de ripícolas, e exigindo compatibilização com regimes legais.(art. 45)

Uses and land classes

Usos preferenciais, admitidos, condicionados e interditos por categoria e subcategoria de solo, conforme Planta de Ordenamento e normas do Regulamento.

  • O regulamento estabelece usos privilegiados por espaço: Espaços Centrais (habitação, comércio, serviços, turismo, equipamentos), Espaços Habitacionais (habitação multifamiliar ou unifamiliar conforme tipo) e Espaços de Atividades Económicas (indústria, armazenagem, logística), entre outros.(art. 93; art. 98; art. 105)
  • No Solo Rústico admitem-se usos ligados à actividade agrícola, florestal e agropecuária, edificação de apoio, empreendimentos turísticos isolados em tipologias específicas, infraestruturas territoriais e edificações para protecção civil, sujeitos a condicionamentos.(art. 49; art. 52)
  • Em Espaços Naturais são privilegiadas actividades de conservação, gestão racional, recreio leve e estruturas amovíveis; são proibidas conversão em agrícola, edificação nova (salvo exceções), introdução de espécies exóticas e infraestruturas urbanas que comprometam valores ambientais.(art. 62; art. 63)
  • Na Rede Natura 2000 são interditas deposição de resíduos, instalação de indústrias poluentes e introdução de espécies não autóctones; atividades em Solo Rústico dependem da conformidade com o Plano Setorial e de parecer vinculativo da autoridade nacional quando aplicável.(art. 10)
  • Na orla costeira (POC OMG) há faixas de proteção e salvaguarda com interdições (ex.: novas edificações na Faixa de Proteção Costeira salvo exceções, alterações ao relevo) e autorizações condicionadas para algumas intervenções de requalificação e infraestruturas de interesse reconhecido.(art. 12; art. 14)

Indicadores, limites de ocupação, número de pisos, profundidades, afastamentos e parâmetros específicos por categorias e UOPG.

  • Para Solo Urbano consagram-se parâmetros gerais: afastamentos mínimos laterais e posteriores (ex.: 3 m para habitação unifamiliar, 5 m lateral para habitação multifamiliar, posterior 5–6 m), profundidade máxima habitacional 18 m e regras sobre corpos balançados, varandas, caves e anexos.(art. 79; art. 80; art. 82; art. 83; art. 85; art. 86)
  • Percentagens máximas de implantação e número máximo de pisos variam por espaço: Espaço Habitacional Tipo 1 (Io implantação até 80 %, pisos até 6), Tipo 2 (implantação até 80 %, pisos até 4), Tipo 3 (implantação até 60 %, pisos até 2), Espaços Centrais e Habitacionais têm regimes próprios.(art. 99; art. 101; art. 103; art. 94)
  • Espaços de Atividades Económicas: implantação até 80 %, afastamentos mínimos (frente 15 m, posterior 10 m, laterais 6 m) e regras de confinamento com espaços habitacionais (20 m ou valores mínimos alternativos).(art. 106)
  • UOPG1 e UOPG2 dispõem de indicadores específicos (ex.: Io e Iu por tipologia e limites de implantação), aplicáveis na execução através de planos de pormenor.(art. 126; art. 127)

Regras sobre execução do Plano, instrumentos de gestão e procedimentos exigidos para operações urbanísticas e UOPG.

  • A execução do PDM processa-se predominantemente por operações urbanísticas ao abrigo do RJUE, exceto UOPG que requerem plano de pormenor para execução detalhada.(art. 121; art. 125)
  • As UOPG (UOPG1 e UOPG2) são executadas por planos de pormenor; até à aprovação destes só se autorizam intervenções que não contrariem os objetivos e mantenham o estatuto rústico conforme qualificação do solo.(art. 125; art. 128)
  • Pedidos de operações urbanísticas devem identificar ocorrências geradoras de servidões ou restrições; em áreas arqueológicas e sensíveis há procedimentos específicos (trabalhos arqueológicos prévios ou acompanhamento) conforme nível de sensibilidade.(art. 7; art. 24)
  • Para polos de relevante geração de deslocações e grandes empreendimentos podem ser exigidos Estudos de Impacte de Tráfego e Transportes e demais estudos técnicos previstos no Regulamento.(art. 37)

What can I build on a plot in Aveiro?
