Can I build on rustic land in Castelo Branco?

About 96% of the territory of Castelo Branco is rustic land. Definitions and land classification

  • Nas áreas de proteção das albufeiras são proibidas operações de loteamento e atividades que aumentem significativamente a erosão; a zona reservada destina‑se à preservação e tem exceções muito limitadas (infraestruturas de apoio, obras em construções legalizadas com condicionamentos).(art. 65)
  • No Parque Natural do Tejo Internacional (PNTI) há atos proibidos (gestão de resíduos, indústrias tipos 1 e 2, exploração de inertes, parques eólicos, edificação em zona reservada da albufeira), e atos condicionados sujeitos a parecer/autorização do ICNF quando legalmente exigido.(art. 72; art. 73)

Building capacity and parameters

Parâmetros de edificabilidade variam conforme a classe de espaço e planos de pormenor; incluem alturas, COS, número de pisos e limites para expansões em áreas protegidas.

  • Número máximo de pisos nos aglomerados sem planos definidos é fixado por local (ex.: Alcains 4, Cebolais/Retaxo 3, restantes sedes 2), com exceções para edifícios em banda até 3 pisos ou 9 m.(art. 32)
  • COS máximos por aglomerado nos aglomerados sem planos: Alcains 0,65; Cebolais/Retaxo 0,65; restantes sedes 0,50; outras áreas 0,50, com possibilidade de majorar 10% ou limites superiores em casos de loteamento específicos.(art. 33)
  • Área urbanizável: número máximo de pisos para novas construções é de três (Castelo Branco, Alcains, Cebolais/Retaxo) e COS máximos em falta de planos: 0,40.(art. 36; art. 37)
  • Nas áreas rurais RAN a área máxima para construção habitacional é 250 m2 e altura máxima 6,5 m (dois pisos), com coeficiente para edificações não habitacionais 0,05 e outras condições de abastecimento e drenagem.(art. 55)
  • No espaço de proteção total e parcial das albufeiras são permitidas obras de conservação e ampliação muito limitadas (por exemplo, ampliações até 25 m2 ou percentagens pequenas, sem aumento de cércea), e na proteção parcial amplições e anexos com limites específicos (ex.: anexos até 150 m2, ampliações até 50% para turismo em espaço rural).(art. 69; art. 70)
  • Em lotes industriais aplicam‑se coeficientes e cérceas específicas: por exemplo COS 0,35 em loteamentos industriais, cércea máxima 8 m e percentagem de impermeabilização máxima 60%; em lotes isolados COS 0,5 e regras de plano de 45° e máximos de 7 m.(art. 40)

Constraints and easements

Servidões, zonas protegidas e condicionantes ambientais e infraestruturais definidas com larguras e regimes específicos.

  • Servidões rodoviárias: para itinerários principais non aedificandi 50 m para cada lado do eixo (nunca menos de 20 m da zona da estrada); itinerários complementares 35 m cada lado (nunca menos de 15 m).(art. 5; art. 6)
  • Servidões ferroviárias: faixas non aedificandi de 50 m (podendo descer a 25 m dentro de perímetros urbanos), com exceções sujeitas a parecer da CP.(art. 9)
  • Servidões relativas à rede elétrica: 50 m para linhas de 60 kW e 20 m para inferiores a 60 kW; dentro de perímetros urbanos aplica‑se legislação específica; proibição de plantações que prejudiquem exploração.(art. 11)
  • As albufeiras de Santa Águeda e Pisco abrangem o plano de água e zona terrestre de proteção de 500 m contados a partir do NPA (cotados 385 m e 498,6 m respetivamente), com regimes específicos nos capítulos VIII e IX.(art. 15)
  • Reserva Ecológica Nacional e Reserva Agrícola Nacional integradas conforme plantas de condicionantes, com uso, ocupação e transformações sujeitas à lei geral e condicionamentos e exceções previstos no regulamento.(art. 16; art. 17)
