Definitions and land classification
O regulamento define conceitos e classes de solo, adotando noções da legislação do ordenamento e discriminando solo rústico e urbano com finalidades e proteções distintas.
- Adopção das noções constantes da legislação nacional de ordenamento do território e urbanismo, com definições de termos técnicos (altura da fachada, área de implantação, área de construção, cave, área de solo).(art. 5)
- Classificação do solo entre Solo Rústico (protecção de recursos, aptidões agrícolas, florestais e geológicas) e Solo Urbano; o solo rústico visa o desenvolvimento do setor primário e conservação de ecossistemas.(art. 21; art. 35)
Uses and land classes
O regulamento especifica usos admissíveis por tipos de solo e espaços, e indica condições de compatibilidade e de adaptação de usos pré-existentes.
- Em solo rústico são enumeradas, entre outras, habitação unifamiliar com anexos, instalações de apoio às atividades agrícolas e florestais, estabelecimentos industriais de transformação ligados ao setor agropecuário, instalações pecuárias, empreendimentos turísticos isolados, centros de interpretação e equipamentos de utilização coletiva.(art. 36)
- Empreendimentos de carácter estratégico são definidos por deliberação municipal quando cumprirem condições (inovação, criação de emprego, investimento mínimo, compatibilidade com valores locais).(art. 32)
- Espaços específicos (florestais, agrícolas, naturais, industriais, turísticos, equipamentos, aglomerados rurais, áreas de edificação dispersa) têm usos admitidos próprios descritos em artigos específicos.(art. 40; art. 42; art. 43; art. 44; art. 46; art. 47)
- As alterações de uso e atividades preexistentes são admitidas quando cumpram condições de manutenção de licenças válidas, não agravem impactos, e atendam a limites de ampliação e compatibilidade previstos no regulamento.(art. 30)
Building capacity and parameters
O regulamento fixa parâmetros de edificabilidade (índices, alturas, número de pisos, áreas mínimas) específicos por categorias de espaços e condiciona ampliações e densidades.
- São fixados índices e parâmetros para espaços florestais, mistos e agrícolas, incluindo índice de utilização, índice de ocupação, índice de impermeabilização, áreas mínimas de implantação e alturas máximas por uso (tabelas e valores indicados no regulamento).(art. 40; art. 42)
- Espaços de ocupação turística e parques de campismo têm parâmetros próprios: p.ex. altura máxima fachada 3 m no parque de campismo e área útil por utilizador, e índices de ocupação/utilização para aldeias típicas em ruínas.(art. 46)
- Áreas de edificação dispersa têm limites de ocupação (índice ocupação 0,30; utilização 0,45), número máximo de pisos (3) e altura máxima de fachada (6,5 m).(art. 48)
- Espaços de atividades económicas e uso especial definem índices e alturas máximas (p.ex. uso económico: ocupação 0,35; fachada 6,5 m; uso especial: ocupação 0,60; fachada 6,5 m), bem como normas específicas para zonas industriais.(art. 58; art. 63)
- Parâmetros de dimensionamento de espaços verdes, arruamentos e estacionamento são indicados em tabelas com áreas mínimas por tipo de uso e perfis viários.(art. 52; art. 39)
Constraints and easements
O regulamento identifica condicionantes territoriais — ambientais, patrimoniais e de risco — que deverão ser observadas e que podem condicionar usos e intervenções.
- A planta de condicionantes integra REN, RAN, risco de incêndio (perigosidade alta e muito alta) e outras condicionantes de utilidade pública, que vinculam o uso do solo.(art. 3)
- Identificam‑se património cultural classificado e em vias de classificação, património arqueológico e arquitetónico, conjuntos e sítios com interesse, e árvores/arvoredo de interesse público sujeitos a condicionamento.(art. 6; art. 14; art. 15; art. 16)
- A Estrutura Ecológica Municipal (EEM) e corredores ecológicos, sistemas húmidos, áreas sensíveis e áreas de risco condicionam operações (proibições de aterros, derrube de árvores, artificialização de drenagens, etc.) e exigem salvaguardas.(art. 9; art. 10)
- Zonas inundáveis têm regras específicas: proibição de aterros e caves, cotas mínimas de soleira (retorno 100 anos) e limitações diferenciadas entre solo urbano e rústico, bem como regras para reconstrução e usos nos aglomerados rurais.(art. 12)
Procedures and execution
O regulamento estabelece instrumentos e procedimentos de execução, unidades de execução (UOPG), planos de urbanização e regras para execução sistemática do Plano.
- O Plano é acompanhado por regulamento, planta de ordenamento, planta de condicionantes, estudos de caracterização, relatório justificativo, programa de execução/financiamento e outros documentos técnicos exigidos.(art. 3)
- A execução sistemática processa‑se por Unidades Operativas de Planeamento e Gestão (UOPG) sujeitas a planos de urbanização/execução; são descritas UOPG 1 a UOPG 8 com objetivos e subunidades específicas.(art. 97; art. 98; art. 99; art. 100; art. 102; art. 103)
