Can I build on rustic land in Fundão?

About 96% of the territory of Fundão is rustic land. That does not mean one may never build, but new housing is as a rule tightly restricted and often prohibited unless the PDM makes an exception (rural settlement, a farmhouse, reconstruction). RAN, REN, protected areas, flood zones or rural fire hazard can still block what the plan would admit. Confirm the class on the map — not only the caderneta predial — and, if in doubt, file a PIP with the Câmara.

Uses and land classes

O regulamento qualifica o solo em categorias e subcategorias, indicando para cada uma os usos principais e complementares admitidos e os critérios de compatibilidade e integração nas respetivas áreas.

  • Enumera categorias de solo rústico e urbano com usos associados (agrícolas, florestais, energéticos, naturais, industriais, culturais, turísticos, equipamentos, infraestruturas, aglomerados rurais, áreas de edificação dispersa; e no urbano: centrais, habitacionais tipo I/II/III, baixa densidade, atividades económicas, uso especial e espaços verdes).(art. 9)
  • Estabelece que os espaços delimitados na Planta de Ordenamento refletem os usos neles admitidos, nos termos do Regulamento.(art. 9)
  • Define critérios gerais de compatibilidade de usos em cada categoria de espaço, privilegiando usos que não prejudiquem a função principal e que não acarretem degradação ambiental, paisagística ou do património.(art. 13)

Building capacity and parameters

O regulamento fixa regimes de edificabilidade por categorias e subcategorias de solo, com quadros e parâmetros específicos (pisos, altura, índices de utilização e impermeabilização) aplicáveis a cada espaço, e prevê exceções e condicionamentos técnico-funcionais.

  • Estabelece que a edificabilidade fica sujeita aos parâmetros previstos por categoria de espaço e apresenta quadros de regime de edificabilidade (ex.: Quadro 14 e Quadro 15 referidos no regulamento) com pisos máximos, alturas e índices de utilização.(art. 13)
  • Especifica regimes para Espaços Urbanos de Baixa Densidade (ex.: índices de impermeabilização, ocupação e alturas indicadas no artigo relativo a baixa densidade) e para Espaços de Atividades (parâmetros de fachada, utilização e afastamentos mínimos aos limites do lote).(art. 84)
  • Prevê majorações de capacidade edificatória até 20% quando cumpridos requisitos de eficiência energética, medidas climáticas, arrendamento ou outras condições previstas, em termos e limites não cumulativos.(art. 2)
  • Define parâmetros urbanísticos específicos por Unidade de Execução, que podem assumir regimes excepcionais quando justificados para a operacionalização da UE.(art. 129)

Constraints and easements

O regulamento identifica e integra servidões administrativas e restrições de utilidade pública e ambientais, bem como regimes específicos de proteção (florestal, hídrico, REN/RAN, áreas protegidas e património) que condicionam ocupação e edificação.

  • Lista servidões e restrições aplicáveis no município, incluindo domínios hídricos, albufeiras (Capinha, Escarigo, Santa Águeda), recursos geológicos, RAN, AHCB, REN, Paisagem Protegida e ZEC (Rede Natura 2000), e infraestruturas como redes elétricas, vias e ferrovias.(art. 6)
  • Regula a defesa da floresta contra incêndios: proíbe, fora do solo urbano, a construção de novos edifícios em áreas de alta/muito alta perigosidade salvo condições cumulativas e excepcionais, e identifica medidas e pareceres exigíveis para autorizações condicionadas.(art. 16)
  • Nas áreas beneficiadas pelo Aproveitamento Hidroagrícola da Cova da Beira (AHCB) são proibidas obras de edificação e usos que comprometam infraestruturas, sendo exigido parecer prévio vinculativo da entidade competente e previsto procedimento de exclusão de prédios da área beneficiada.(art. 12)

Procedures and execution

O regulamento regula procedimentos de integração de preexistências, legalização de construções, execução por Unidades de Execução e mecanismos de perequação, exigindo documentação técnica e cumprimento de requisitos prévios em vários casos.

  • Define preexistências e condições para manutenção, alteração ou ampliação das mesmas, incluindo limites (ampliações até 40% admitidas em determinados casos) e requisitos de conformidade com parâmetros urbanísticos e ambientais.(art. 14)
  • Prevê Unidades de Execução (UE1 a UE9) com objetivos programáticos, parâmetros urbanísticos e prazos de execução; o Município pode promover a constituição de novas UEs e a delimitação pode caducar se os prazos não forem cumpridos.(art. 129)
  • Define mecanismos de perequação compensatória, com cálculo de edificabilidade média, área de cedência média e repartição dos custos de urbanização, nos termos do Regime Jurídico dos Instrumentos de Gestão Territorial.(art. 126)

Can one build on rustic land in Fundão?

What can I build on a plot in Fundão?

It depends on the plot's land class on the zoning map and on the rules in the Fundão PDM regulation. On urban land, housing and other uses are admitted within the class parameters (area, height, setbacks, indices).
