Definitions and land classification

O regulamento define classes de uso e termos urbanísticos específicos, incluindo tipologias de empreendimentos e unidades funcionais.

  • Empreendimentos turísticos: estabelecimentos de alojamento mediante remuneração com equipamentos e serviços complementares.(art. 2)
  • Equipamento de apoio aos utentes da rodovia: área associada a estação de serviço, restauração e comércio de reduzida dimensão.(art. 2)
  • Unidade funcional: prédio ou fração urbana afetos a uma utilização (habitação, comércio, serviços, indústria).(art. 2)
  • Usos definidos: habitacional, industrial e terciário com as respetivas afetações características.(art. 2)

Constraints and easements

O regulamento enumera servidões, reservas e áreas protegidas que condicionam ocupação e intervenção, incluindo faixas de proteção específicas.

  • Lista de servidões administrativas e restrições de utilidade pública: Domínio Público Hídrico, Albufeiras, REN, RAN, Rede Natura 2000, proteção a imóveis classificados, redes de infraestruturas, entre outras.
  • Faixas de proteção e restrições quanto a condutas, aqueduto e ETAR: afastamentos mínimos e proibições de alterações topográficas na envolvente do Aqueduto e faixas junto de condutas e reservatórios.(art. 78-A)

Uses and land classes

O regulamento especifica usos admitidos por categorias de solo (urbano, rústico e subcategorias rurais), com regras e condicionamentos por tipo de espaço.

  • Espaços Agrícolas e Florestais: admitidos ETI, NDT, equipamentos de interesse público, apoio às atividades agrícolas, habitação conforme artigos específicos e indústria de primeira transformação.(art. 78-C)
  • Espaços Rurais Envolventes da Cidade: usos agrícolas, forestais, pastorícia e instalação condicionada de ETI/NDT e equipamentos que não impliquem loteamento nem destruição do solo vivo.(art. 86)
  • Zonas de Proteção Ambiental e de Especial Valor Patrimonial: usos preferenciais de conservação, educação ambiental e atividades de baixo impacto, com proibições específicas (p.ex. loteamento, pecuária intensiva).(art. 124-C)

Building capacity and parameters

O regulamento define parâmetros de edificação por categorias e espaços, como índices, alturas máximas, percentagens de ocupação e regras para anexos e logradouros.

  • Bairros periféricos (exceto Canaviais): construção lote a lote, ocupação até 30 m de profundidade, índice de utilização líquido ≤ 0,8, máximo de 2 pisos e altura máxima de fachada 6,5 m para dois pisos; 50% do logradouro deve manter-se permeável.
  • Empreendimentos turísticos (ETI/NDT): índices específicos (ex.: impermeabilização máxima 0,2 para NDT salvo exceções), limites de implantação, área mínima para NDT (50 ha) e parâmetros de capacidade e área por unidade de alojamento.(art. 78-C)

O regulamento prevê instrumentos de execução e mecanismos de gestão (planos de pormenor, UOPG, contratos para NDT) e condiciona a documentação e pareceres para licenciamento.

  • NDT condicionados à celebração prévia de contrato entre município e promotores, incluindo programa de execução, perequação e sanções (caducidade, reversão) e apresentação de estudos de viabilidade e simulações.(art. 78-C)
  • Licenciamento e pareceres: operações em áreas sensíveis, faixas de proteção e albufeiras exigem pareceres e cumprimento de condicionamentos, estudos de simulação e cumprimento de legislação setorial.(art. 3; art. 42)

Can one build on rustic land in Évora?

Not automatically. New housing on rustic land is as a rule tightly restricted and, in agricultural or forest classes, often prohibited — unless the Évora PDM makes an exception (rural settlement, a house tied to a farm, rural tourism, reconstruction of a pre-existence). RAN, REN, protected areas, flood zones or rural fire hazard can still block what the PDM would admit. A listing that says “construction is possible” does not replace the map or a PIP at the Câmara Municipal.

How does one know the class of a specific plot?

These pages describe the concelho. The caderneta predial is not enough: «prédio rústico» in the tax register is not «solo rústico» in the PDM. Use Explore with the exact point, cross it with the regulation and, for a concrete proposal, file a PIP with the Câmara Municipal of Évora.

What can I build on a plot in Évora?

It depends on the plot's land class on the zoning map and on the rules in the Évora PDM regulation. On urban land, housing and other uses are admitted within the class parameters (area, height, setbacks, indices). On rustic land the use is more restricted and new housing is often conditional or prohibited. Only reading the specific plot on the map, cross-checked with the regulation and the constraints, confirms what is possible.

How much can I build on a plot in Évora?

Legalising works without a permit depends on the regulation and the applicable constraints. Always confirm with the Câmara, preferably through a PIP.

How is rustic land reclassified as urban in Évora?

Reclassifying rustic land as urban is a decision of the Câmara Municipal within the plan, subject to strict RJIGT conditions (since 2025, as a rule contiguity with urban land and an affordable or public-housing component). It is not a landowner's right, nor is it obtained through an individual building request.
