Can I build on rustic land in Murça?

Uses and land classes
O regulamento classifica usos por tipos de espaço e especifica compatibilidades e condicionamentos para actividades económicas, equipamentos, culturais, turísticos e industriais, bem como regras para espaços verdes e centrais.
- Os espaços de atividades económicas destinam-se a indústrias, armazenagem, serviços terciários e equipamentos de apoio, sendo admitidas obras de ampliação/reconstrução desde que garantida integração urbanística, recuos e compatibilidades com a envolvente.(art. 9; art. 51)
- Espaços culturais e de interesse público acolhem intervenções de apoio, instalações leves e ampliação desde que não afetem negativamente valores patrimoniais, paisagísticos ou funcionais.(art. 43; art. 44)
- Espaços destinados a equipamentos incluem redes de água, saneamento, energia e infraestruturas públicas, com condicionamento específico e necessidade de pareceres quando incidirem em áreas florestais.(art. 44)
- Nos espaços centrais admite-se habitação (incluindo colectiva), comércio e serviços, turismo e atividades compatíveis com a predominância habitacional, sujeitas a condicionamentos de utilização por piso e acesso independente em alguns casos.(art. 46)
- Admite‑se coexistência de habitação e unidades de indústria/armazenagem em mesmos edifícios quando compatíveis, e a instalação de indústrias/armazenagem em solos urbanizados ou urbanizáveis com requisitos de recuos e índices.(art. 18)

Building capacity and parameters
O regulamento fixa parâmetros de índices e limites de altura, recuos, ocupação e índices de utilização aplicáveis a diversas categorias de solo e operações urbanísticas, e prevê mecanismos de cedência e perequação.
- Definem‑se parâmetros como índice de utilização do solo (Iu), índice de ocupação (Io), e limitações de cércea/altura de fachadas, com exemplos (Iu referenciado em espaços centrais e o Io em condicionamentos), devendo respetivos valores respeitar as plantas e normas municipais.(art. 46)
- Em espaços de atividades económicas a edificabilidade está condicionada à correta integração, estacionamento e o índice de utilização não pode ser superior a 1,20 nesse tipo de espaços.(art. 51)
- Para indústrias/armazenagem em prédios autónomos ou urbanos exigem‑se cumprimento da lei, altura de fachada máxima (citada), Io limitada, recuo mínimo de 5 metros e compatibilidade morfológica.(art. 18)
Constraints and easements
O Plano inclui uma Planta de Condicionantes com servidões e restrições (hídricas, geológicas, agrícolas, florestais, ecológicas, infraestruturas e património) e regras específicas para defesa da floresta e risco de incêndio.
- A proteção de recursos hidrominerais estabelece perímetros (imediata, intermédia e alargada) com proibições e condicionamentos sobre edificações, sondagens, aterros, uso de químicos e despejo de resíduos, condicionadas a autorizações de entidades competentes.(art. 7)
- Medidas de defesa contra incêndios obrigam a faixas de proteção, gestão de combustível, lâminas de corte e exigem que novas edificações em áreas florestais cumpram o PMDFCI e normas regionais, com parecer do ICNF quando aplicável.(art. 12)
- Proteções do património incluem listagens de monumentos, conjuntos e sítios arqueológicos e condicionam a ocupação e transformação do solo conforme legislação aplicável.

O regulamento prevê instrumentos de gestão e execução (Planta de Ordenamento, Condicionantes, Estudos, Planos de Pormenor, Unidades de Execução) e condicionalismos para licenciamento e cedências em operações urbanísticas.

Not automatically.
