Can I build on rustic land in Lagoa?

About 84% of the territory of Lagoa is rustic land. That does not mean one may never build, but new housing is as a rule tightly restricted and often prohibited unless the PDM makes an exception (rural settlement, a farmhouse, reconstruction). RAN, REN, protected areas, flood zones or rural fire hazard can still block what the plan would admit. Uses and land classes

O regulamento define usos dominantes, complementares e compatíveis para diferentes categorias de espaço, incluindo equipamentos, usos agrícolas, turísticos e de recreio, com condicionamentos específicos conforme a subcategoria.

  • Usos dominantes e complementares nos espaços agrícolas: atividade agrícola como uso dominante; usos complementares incluem pecuária, agroflorestal, indústria de primeira transformação e edificações de apoio (uso compatível TER/TH e habitação do proprietário-agricultor) .(art. 1-C; art. 1-A)
  • Em outros espaços agrícolas, usos compatíveis incluem aproveitamento de recursos geológicos, NDT, abrigos amovíveis, equipamentos sociais, PCC, áreas de serviço para autocaravanas, centrais fotovoltaicas e instalações de recreio, sujeitos a regimes específicos.(art. 1-C)
  • Espaços centrais destinam-se preferencialmente a usos residenciais, com equipamentos coletivos e comércio/serviços de proximidade como usos complementares e compatíveis; instalações industriais/logística só após demonstração da inexistência de impacto.(art. 1-O; art. 1-O)
  • Parques de campismo e caravanismo em solo rústico admitem-se condicionadamente, exigindo prévia aprovação, contratualização, classificação e requisitos de adaptação ambiental e infraestruturas.(art. 43; art. 46)

Building capacity and parameters

O regulamento estabelece parâmetros e limitações de edificabilidade conforme categorias de solo (urbano/rústico, faixas costeiras, espaços habitacionais), incluindo alturas máximas, número de pisos e regras específicas para ampliações e reabilitação.

  • Edificação em solo rústico para residência própria do agricultor: área mínima do prédio, integração em exploração viável, ónus de inalienabilidade por 10 anos, área máxima de construção e altura máxima de fachada (7,5 m) e número máximo de pisos (2).(art. 31)
  • Espaços habitacionais: subcategorias (consolidados, alta densidade, baixa densidade) com objetivos específicos de manutenção/qualificação e parâmetros de edificabilidade aplicáveis consoante a subcategoria; reabilitação urbana incentivada por instrumentos de pormenor.(art. 20; art. 60)
  • Faixa costeira e proteção às arribas: definição de faixas (margem, zona terrestre de proteção, retaguarda) e condicionamentos de ocupação, com limites de altura e exigência de estudos/obras de consolidação para alterações significativas.(art. 18)
  • Parques de campismo e empreendimentos turísticos: parâmetros específicos de implantação e condicionamentos de permeabilidade, estacionamento e classificação para autorização em solo rústico.(art. 46; art. 40)

Constraints and easements

O regulamento detalha condicionantes ambientais, hidrológicos, florestais, arqueológicos e infraestruturais que afetam o uso do solo, prevalecendo servidões e restrições mais exigentes sobre o regime de uso.

  • Estrutura Ecológica Municipal (EEM) com áreas nucleares (ZEC PTCON0052, PTZPE0016, leitos de transição, arribas, praias) e corredores de conetividade; áreas nucleares sujeitas a proibições e regras específicas.(art. 6; art. 1-A)
  • Servidões administrativas representadas na Planta de condicionantes: domínio hídrico (leitos e margens com larguras definidas), RAN, REN, Rede Natura 2000, perímetros de proteção de captações (0–50 m / 0–300 m / 300–1000 m) e áreas críticas de extração; limites e proibições aplicam-se conforme artigos indicados.(art. 1-N; art. 15; art. 17)
  • Condicionamentos relativos a infraestruturas: proibição de edificação sobre coletores/traçados, faixas de proteção ao longo de condutas (5–10 m/100 m) e afastamentos mínimos a estações de tratamento (100 m), devendo intervenções comunicar às entidades competentes.(art. 1-N)
  • Perigosidade de incêndio florestal e cheias: áreas classificadas com interdição de novas habitações em zonas de alta/muito alta perigosidade, aplicação do PMDFCI e RMUE para regras de defesa; áreas de perigosidade às cheias com proibições (ex.: caves) e exigência de planos de prevenção quando aplicável.(art. 14)
  • Património arqueológico e edificado: operações urbanísticas em zonas de sensibilidade arqueológica sujeitas a pareceres e acompanhamento arqueológico; demolições e intervenções sobre bens patrimoniais exigem requisitos e podem ser proibidas se colocarem em risco os bens.(art. 97; art. 20)

Procedures and execution

O regulamento exige documentos, pareceres e processos prévios para obras em áreas condicionadas, define sistemas de execução do PDM e prevê monitorização e legalização de situações existentes.

  • Alterações do uso e operações em áreas da EEM e REN sujeitas a regimes legais e a parecer obrigatório (ex.: Instituto da Conservação da Natureza e das Florestas para ZEC e perímetros hidroagrícolas), exigindo demonstrações e documentos técnicos nas comunicações/pré‑licenciamentos.(art. 1-A; art. 1-N)
  • Delimitação do domínio hídrico e servidões representadas na Planta de condicionantes: em caso de dúvida a entidade competente define áreas sujeitas; intervenções que alterem vegetal ou elementos da Rede devem ser comunicadas à Direção‑Geral do Território (trabalhos com Nivelamento Geométrico de Alta Precisão).(art. 1-N)
  • Execução do PDML por unidades de execução e outros sistemas previstos no RJIGT; aprovação de unidades de execução exige contrato, identificação de prédios, faseamento, garantias e regras de perequação, com possibilidade de delimitação obrigatória pela Câmara.(art. 89)
  • Monitorização permanente do PDML com três eixos (execução, impactes, estratégico) e atualização da Planta de ordenamento e condicionantes mediante procedimentos de republicação quando houver alterações relevantes.(art. 93; art. 97)
  • Regime de legalização de operações anteriores à versão inicial do PDM (15/05/1994) mediante prova documental, conformidade técnica, ligação a infraestruturas e pareceres das entidades competentes; caducidade de autorizações em determinados prazos prevista.(art. 42)

What can I build on a plot in Lagoa?

A building with proven legal existence may, depending on the Lagoa PDM, be rehabilitated or reconstructed under conditions sometimes more accessible than a wholly new build. Legalising works without a permit depends on the regulation and the applicable constraints. Always confirm with the Câmara, preferably through a PIP.

How is rustic land reclassified as urban in Lagoa?

Reclassifying rustic land as urban is a decision of the Câmara Municipal within the plan, subject to strict RJIGT conditions (since 2025, as a rule contiguity with urban land and an affordable or public-housing component).
