Can I build on rustic land in Loulé?

About 92% of the territory of Loulé is rustic land. That does not mean one may never build, but new housing is as a rule tightly restricted and often prohibited unless the PDM makes an exception (rural settlement, a farmhouse, reconstruction). Definitions and land classification

O regulamento classifica e define subcategorias de solo e espaços, indicando finalidades gerais de cada categoria.

  • Os espaços urbanizáveis são definidos como passíveis de programação e de vir a adquirir características de espaço urbano, incluindo subcategorias específicas de expansão e outras funções.(art. 21; art. 22)
  • Os espaços urbanos de expansão subdividem-se em Tipos A, B e C (com lista de localidades associadas) e destinam‑se à construção de novas áreas residenciais e funções complementares.(art. 23)
  • Os espaços agrícolas dividem‑se em quatro subcategorias: Áreas da RAN, áreas de uso predominantemente agrícola, Áreas de agricultura condicionada I e II.(art. 36)

Uses and land classes

O regulamento especifica usos admitidos ou condicionados por categoria de solo, com menção a indústrias, equipamentos e equipamentos turísticos e turísticos especiais.

  • Nos espaços urbanos admite‑se instalação de unidades industriais não poluidoras compatíveis com uso habitacional e armazéns sem grande movimentação de cargas, com obrigatoriedade de ligação às redes de saneamento.(art. 17)
  • As áreas urbano‑turísticas são destinadas a empreendimentos turísticos e usos complementares, sendo que intervenções fora de planos municipais vigentes obedecem a princípios e parâmetros específicos.(art. 16)
  • Áreas industriais destinam‑se à construção de estabelecimentos industriais e não se podem localizar noutras áreas, exigindo plano de pormenor ou loteamento para novos espaços.(art. 32; art. 33)
  • Áreas destinadas a atividades de interesse económico local admitem comércio, serviços, armazenagem, pequenas oficinas e, quando pertinente, indústrias não poluidoras sujeitas a legislação ambiental.(art. 28)
  • As áreas de reconversão urbanística e alguns espaços naturais podem admitir equipamentos compatíveis com a sensibilidade do local, mediante plano de urbanização ou pormenor.(art. 35)

Building capacity and parameters

O regulamento fixa parâmetros de ocupação, alturas e afastamentos em áreas específicas, sobretudo para empreendimentos turísticos e edificações isoladas em solo rural.

  • Em áreas urbano‑turísticas, o coeficiente de ocupação do solo (COS) é fixado: para empreendimentos de 4 e 5 estrelas ≤ 0,50; para outras categorias ≤ 0,40.(art. 16)
  • Altura máxima em empreendimentos turístico‑urbanísticos: 15 m para 4 e 5 estrelas e 13,5 m para outras categorias; afastamentos mínimos aos limites: 13,5 m (4/5 estrelas) e 12,5 m (outras).(art. 16)
  • Para edificação isolada em solo rural (habitação do agricultor e usos associados) exigem‑se áreas mínimas de propriedade (10 ha na UT Litoral Sul e Barrocal; 5 ha nas restantes), limites de construção (habitação 500 m2; outros usos 2 000 m2), altura máxima 7,5 m e máximo de 2 pisos.(art. 88-A)
  • Em espaços naturais e em áreas florestais quando a edificação é permitida, aplica‑se o disposto ao capítulo relativo à edificação em solo rural e normas do POPNRF quando pertinente.(art. 44; art. 54)
  • Na faixa costeira a 'Margem' e 'Zona Terrestre de Proteção' não autorizam novas construções fora dos perímetros urbanos, com exceções para infraestruturas e equipamentos de interesse público ou balnear conforme planos especiais.(art. 88-E; art. 88-F)

Constraints and easements

O regulamento lista servidões, zonas protegidas e regimes aplicáveis como REN, RAN, rede Natura e proteção do património, além de condicionamentos rodoviários, hidráulicos e outros.

  • Identificam‑se servidões e restrições de utilidade pública incluindo REN, RAN, proteções florestais, indústria extrativa, proteções a monumentos, ferrovias, rodovias, captações de água, redes de água e esgotos, redes elétricas e domínio hídrico.(art. 64)
  • As áreas integradas na Reserva Ecológica Nacional (REN) e na Reserva Agrícola Nacional (RAN) são as assinaladas na planta de condicionantes e regem‑se pelos respetivos regimes jurídicos.(art. 65; art. 67)
  • Proteções ao património cultural edificado incluem zonas de proteção (até 50 m salvo regimes específicos) e exigem pareceres ou autorizações de entidades competentes para intervenções na zona de proteção.(art. 71)
  • As limitações rodoviárias estabelecem faixas non aedificandi (por ex.: autoestradas e vias rápidas: 50 m cada lado; IC: 35 m; EN e restantes: 20 m), e identificam a rede rodoviária nacional e regional no concelho.(art. 73)
  • Áreas integradas no Parque Natural da Ria Formosa e outros sítios classificados estão sujeitas ao respetivo plano setorial e ao POPNRF, aplicando‑se o regime setorial correspondente.(art. 80; art. 83)
  • Condições específicas aplicam‑se à proteção de captações e redes de água, incluindo faixas interditas à construção (ex.: 50 m em torno de reservatórios; faixas ao longo de adutoras e condutas).(art. 75; art. 74)

Procedures and execution

O regulamento estabelece procedimentos para criação de NDT, concursos públicos, documentação e avaliação de propostas, e remete para mecanismos de regularização e instrumentos de planeamento.

  • A criação de Núcleos de Desenvolvimento Turístico (NDT) depende de concurso público com parecer prévio do Observatório do PROT Algarve e da celebração de um acordo base entre Câmara e promotor, seguido de plano de pormenor ou urbanização.(art. 63)
  • O concurso de NDT exige publicitação em Diário da República e imprensa, e inclui programa de concurso e caderno de encargos, ambos sujeitos a envio prévio ao Observatório do PROT para parecer.(art. 63-A; art. 63-B)
  • O júri do concurso é designado pela Câmara Municipal e integra a CCDR Algarve e Turismo de Portugal, competindo‑lhe conduzir o concurso e atuar como autoridade instrutora quando aplicável.(art. 63-C)
  • As propostas admitidas são sujeitas a consulta pública e avaliação segundo critérios urbanísticos, económicos, sociais e ambientais, e a Câmara delibera sobre a admissão e escolha da proposta mais vantajosa.(art. 63-F; art. 63-G; art. 63-H)
  • A elaboração e aprovação do instrumento de planeamento e celebração do acordo base devem respeitar o princípio da legalidade e as prescrições do PDM, servidões e regimes legais aplicáveis.(art. 63-J)
  • A alteração pretendeu criar norma habilitante para a regularização excecional de operações urbanísticas sem controlo prévio, nos termos da Lei n.º 31/2014 e do Decreto‑Lei n.º 136/2014.(art. 56)
  • Nos planos de pormenor e urbanização devem aplicar‑se mecanismos de perequação compensatória nos termos do RJIGT.(art. 91)

What can I build on a plot in Loulé?
