Definitions and land classification

Classificação do plano e conceitos de solo constam do Regulamento, incluindo composição do PDM e categorias gerais do solo.

  • O PDM integra Regulamento, Plantas de Ordenamento e Condicionantes e vários relatórios e anexos técnicos listados pelo regulamento.(art. 3)

Constraints and easements

O regulamento enumera servidões e restrições de utilidade pública, identificando recursos e áreas protegidas com regimes específicos.

  • São identificadas várias restrições e servidões: domínio hídrico, zonas inundáveis, albufeiras, REN, Parque Natural Regional do Vale do Tua, RAN, áreas florestais e classes de perigosidade de incêndio, entre outros.(art. 6)

Uses and land classes

O regulamento estabelece usos admissíveis por categorias de solo (rústico, florestal, agrícola, naturais, turísticos, industriais e urbanos) com compatibilidades e condicionamentos.

  • No solo rústico são admitidas infraestruturas, instalações de abastecimento, vigilância e apoio a incêndios, equipamentos de lazer (com limites de impermeabilização) e pesquisa geológica, com condicionamentos relativos à proteção de valores naturais.(art. 22)
  • A edificação nova isolada para fins habitacionais em solo rústico é, em regra, condicionada à titularidade agrícola, inexistência de outra habitação, exploração com área mínima de 2 ha e habitação unifamiliar.(art. 22)
  • Nos aglomerados rurais admitem‑se habitação, comércio e serviços complementares, instalações de apoio agrícola, equipamentos de utilização colectiva e empreendimentos turísticos compatíveis.(art. 24)
  • Espaços agrícolas destinam‑se sobretudo a usos agrícolas e manutenção do uso agrícola, incluindo habitação para uso próprio quando autorizada pelas normas aplicáveis.(art. 26; art. 27)
  • Espaços florestais distinguem conservação e produção; ambos admitem usos compatíveis como actividades agrícolas e pastorais, apoio à gestão florestal e, em casos, turismo de natureza, conforme PROF Douro e PMDFCI.(art. 29; art. 32; art. 35)
  • Espaços naturais e paisagísticos privilegiam usos conservacionistas; são permitidas atividades de manutenção e educação ambiental, alguns equipamentos e turismo de baixo impacto, sujeitas a parecer da entidade gestora do PRNVT.(art. 39; art. 40)
  • Espaços consolidados de exploração de recursos autorizam exploração mineral, pedreiras e atividades transformadoras conexas, com medidas de salvaguarda ambiental.(art. 42; art. 43)
  • Espaços de ocupação turística permitem a instalação de todo o tipo de empreendimentos turísticos identificados na Planta, como Complexo do Peneireiro e Aldeia de Gavião.(art. 49; art. 50)
  • No solo urbano definem‑se espaços centrais, habitacionais, de atividades económicas, uso especial e espaços verdes, com funções e usos compatíveis indicados pelo regulamento.(art. 57; art. 60; art. 63; art. 69)

Building capacity and parameters

O regulamento fixa parâmetros e índices diferenciados por categorias de espaço, com limites de índice de utilização, número de pisos, áreas máximas e alturas em várias situações.

  • No solo rústico, em casos de colmatação ou reconstrução, pode aplicar‑se um índice de ocupação do solo de 1,0; condições de implantação e número de pisos são definidas por subcategoria.(art. 22)
  • Espaços de uso múltiplo agrícola e florestal: índice de utilização do solo típico 0,1 com máximo de um piso e, em casos específicos, até dois pisos acima da soleira, aplicando‑se limites de altura e implantação conforme tipologia.(art. 37)
  • Espaços consolidados de exploração de recursos permitem reconstrução e obras até área máxima de 300 m2 em geral, com alturas que não deverão exceder 7 m salvo condições específicas.(art. 42)
  • Espaços de equipamentos aplicam parâmetros que incluem alturas normalmente até 10 m de fachada (exceptuando necessidades técnicas) e índices de ocupação/uso específicos (ex.: índice 0,6 ou 0,7 e até 3 pisos conforme o tipo de equipamento).(art. 51; art. 52)
  • Em espaços de uso especial e habitação urbana existem referências a limites de altura de fachada (17 m) e necessidade de conservar características arquitectónicas, sem lista exaustiva de todos os parâmetros no excerto fornecido.(art. 56; art. 62)

Procedures and execution

O Plano define execução por unidades de planeamento e gestão (UOPG), planos de pormenor e operações de loteamento, com programação municipal e instrumentos de compensação.

  • A execução do PDM deve processar‑se através de operações de urbanização, planos de pormenor e Unidades de Execução, observando instrumentos de gestão territorial e legislação aplicável.(art. 77; art. 2)
  • Foram instituídas Unidades Operativas de Planeamento e Gestão (UOPG1 a UOPG13) que requerem programação específica e algumas com execução obrigatória de Planos de Pormenor ou Planos de Intervenção no Espaço Rústico.(art. 79; art. 80)
  • A programação da execução deve integrar ações programáticas (expansão urbana, integração de espaços verdes, mobilidade, água e proteção ambiental) e a Câmara Municipal é responsável pela programação e elaboração dos instrumentos de execução.(art. 74; art. 80)

Can one build on rustic land in Vila Flor?

Not automatically. New housing on rustic land is as a rule tightly restricted and, in agricultural or forest classes, often prohibited — unless the Vila Flor PDM makes an exception (rural settlement, a house tied to a farm, rural tourism, reconstruction of a pre-existence).
