Can I build on rustic land in Baião?

Uses and land classes
O Plano organiza o território em tipos de espaços e diz, de forma geral, que cada tipo tem usos preferenciais e usos compatíveis que uma família ou comprador deve verificar antes de comprar.
- Espaços centrais — Destinam‑se a comércio, serviços e também habitação mista, sendo prioridade manter a atividade urbana e os equipamentos.(art. 33)
- Espaços habitacionais — Destinam‑se sobretudo a habitação, admitindo comércio e serviços de proximidade compatíveis com a vida residencial.(art. 35; art. 36)
- Baixa densidade — Áreas com habitação mais dispersa; aceitam‑se usos habitacionais e atividades compatíveis em menor intensidade.(art. 38)
- Equipamentos e turismo — Espaços específicos para equipamentos coletivos e para uso turístico com regras próprias (por ex. campos de golfe, alojamento), devendo haver integração paisagística e requisitos de água/infraestruturas.(art. 17; art. 78)
Building capacity and parameters
O Plano fixa quanto se pode construir (índices) e limites de altura e implantação por tipo de espaço e por situações especiais; também prevê mecanismos de perequação quando a capacidade se distribui entre proprietários.
- Índices médios por tipo — Há índices médios (IUm) para cada tipo: Espaços centrais ~1,6, habitacionais ~1,2, baixa densidade ~0,8, e índices específicos para áreas de atividades, definidos nas UOPG e Anexo VI.(art. 36; art. 38; art. 61)
- Alturas e pisos máximos — O Plano fixa alturas de fachada máximas por categoria (ex.: espaços centrais até 14 m, habitacionais até 11 m, baixa densidade 7 m), salvo soluções justificadas tecnicamente.(art. 33; art. 35)
- Impermeabilização e implantação — Existem limites para área impermeabilizada e área de implantação (variam por categoria e por operação), para proteger solos e controlar enchentes — verificar o limite aplicável ao local.(art. 23; art. 33)
- Solo rústico (edificações agrícolas) — No solo agrícola há regras próprias: novas habitações ligadas a explorações só com índices baixos (ex.: IU até 0,08) e alturas até 7 m; ampliações e edifícios de apoio têm limites específicos.(art. 48)
- Unidades de execução e UOPG — Para concretizar UOPG ou unidades de execução, o Plano pode exigir uma edificabilidade média global e regras próprias na forma de execução (podem existir índices concretos por UOPG).(art. 56; art. 58)
- Perequação da edificabilidade — Quando a capacidade de construir não coincide com a propriedade, há mecanismos para repartir a edificabilidade e custos (compensações, cessões, fundo municipal), conforme os artigos sobre perequação.(art. 61; art. 64)
Constraints and easements
Há várias restrições que podem impedir ou condicionar obras: áreas protegidas, património, risco de cheias, riscos florestais, redes e servidões; verifique sempre a Planta de Condicionantes e os anexos aplicáveis.
- Rede Natura 2000 — Existem áreas e habitats protegidos (ex.: ZEC Alvão/Marão) com condicionamentos e pareceres obrigatórios para ações que possam afetar os habitats.(art. 20)
- Proteção contra incêndios — Em solo rústico existem afastamentos mínimos, faixas de proteção e exigência de medidas de silvicultura preventiva e de gestão integrada de fogos; obras perto de matos/forestas têm condições especiais.(art. 5)
- Património cultural — Há muitos bens classificados e inventariados (Igrejas, casas solarengas, antas, mamoas) com perímetros de proteção que limitam obras e exigem pareceres e planos de intervenção.(art. 8)
- Servidões e infraestruturas — Servidões administrativas (faixas rodoviárias, redes de água, estações, condutas) e perímetros de proteção determinam zonas não edificáveis ou com limitações próprias.(art. 4; art. 69)
Procedures and execution
O Plano exige passos formais: planeamento complementar em UOPG, planos de urbanização/pormenor, licenciamento, pareceres especializados e mecanismos de execução (unidade de execução, operações de loteamento).
- UOPG e unidades de execução — Áreas maiores (UOPG) exigem estudos e execução por unidades de execução ou planos de pormenor, com prazos e programas de execução.(art. 58; art. 56)
- Formas de concretizar — O Plano pode executar‑se de forma sistemática (unidades de execução) ou não sistemática (licenças e operações isoladas) consoante os requisitos definidos.(art. 55)
- Pareceres obrigatórios — Obras em áreas sensíveis podem exigir pareceres de autoridades externas (água, ambiente, património, floresta, autor. nacional da água) antes do licenciamento municipal.(art. 90; art. 20)
Definitions and land classification
Os termos técnicos usados no Plano são explicados (alguns no Anexo I); abaixo estão definições simples para quem compra ou constrói.
- Índice de utilização — Significa quanto se pode construir em relação ao terreno (área de construção por m2 de terreno).(art. 61)
- Cércea (altura) — Altura do edifício medida na fachada (o Plano fixa limites máximos por tipo de espaço).(art. 33)
- Edificabilidade — O que e quanto se pode construir num terreno; o Plano distingue 'edificabilidade abstrata' (direito genérico definido pelo Plano) e 'edificabilidade concreta' (o que é autorizado efetivamente).(art. 61)
