Can I build on rustic land in Cuba?

Municipal cartography does not yet allow a reliable land-classification percentage. The correct reading is the zoning map, the regulation and the overlays (RAN, REN, protected areas, flood zones, rural fire hazard), class by class — and, for a concrete proposal, file a PIP with the Câmara.

Definitions and land classification

Classificação do solo e conceitos urbanísticos adoptados no Regulamento, incluindo medidas básicas e categorias de espaços.

  • O Regulamento define conceitos como superfície do terreno, superfície bruta, líquida, lote, implantação, STP, índices de utilização e ocupação, densidades e volumetria máxima.(art. 4)

Uses and land classes

O Regulamento estabelece as categorias de uso por tipos de áreas e as condições ou finalidades admitidas em cada uma.

  • Áreas residenciais: predominância da função habitacional e regras de conservação e integração das construções existentes e novas.(art. 33; art. 45; art. 46; art. 47)
  • Áreas para equipamentos: uso predominantemente destinado a equipamentos colectivos; área norte da vila de Cuba sujeita a plano de pormenor com equipamentos desportivos e de lazer previstos.(art. 34; art. 55)
  • Áreas turísticas: destinadas a empreendimentos turísticos indiferenciados, sujeitas a planos de pormenor e obrigatoriedade de projectos de arranjo exterior, com infra‑estruturas próprias para drenagem e tratamento de águas residuais.(art. 35; art. 56; art. 57; art. 58)
  • Turismo rural/agroturismo: admitidos em explorações agrícolas, preferencialmente em edifícios existentes, e sujeitos à legislação em vigor.(art. 60; art. 1)

Building capacity and parameters

Parâmetros de construção, índices e limites de altura/número de pisos aplicáveis em diferentes áreas.

  • Definições e manutenção da STP; manutenção da superfície total de pavimentos das construções existentes salvo exceções para pequenas ampliações ou necessidade de melhorar imagem/funcionalidade.(art. 4; art. 48; art. 50)
  • Número máximo de pisos: até 3 pisos na vila de Cuba (definido em planos de urbanização/plans de pormenor, não podendo ultrapassar 3) e 2 pisos nos outros aglomerados (Faro do Alentejo, Albergaria dos Fusus, Vila Alva, Vila Ruiva); RPVA e espaços agrícolas/florestais limitam a 2 pisos.(art. 51; art. 74; art. 81; art. 83)
  • Índices e limites específicos: índice de construção máximo para espaços industriais de 0,4; cércea máxima 7 m (salvo instalações especiais); índice de construção máximo junto à albufeira turística 0,06; densidades populacionais máximas para espaços urbanizáveis por aglomerado (100, 75, 50 hab/ha conforme artigo).(art. 69; art. 69; art. 62; art. 52)
  • Estacionamento: normas nos espaços industriais (1 lugar/150 m2 de área bruta de construção, 1/100 m2 para lotes >1000 m2) e referência a Portaria para áreas residenciais.(art. 70; art. 53)

Constraints and easements

Servidões, zonas de protecção e restrições ambientais, patrimoniais e infra‑estruturais previstas pelo Regulamento.

  • Servidões rodoviárias e faixas de protecção regidas pela legislação específica; em vias municipais não se permitem construções a menos de 5 m da zona da estrada; zonas de respeito definidas por planos de urbanização (artigos 6,7,8,9).(art. 6; art. 7; art. 8; art. 9)
  • Servidão ferroviária: interdita construção a menos de 10 m da aresta superior da escavação/aresta inferior do talude, com possibilidade de aumento por segurança.(art. 10)
  • Servidões das redes elétricas: afastamentos mínimos de 3 m (≤60 kV) e 4 m (≥60 kV), com aumentos para terraços e outras regras de proximidade a edifícios.(art. 11)
  • Servidões hidráulicas e de drenagem: faixas de 10 m em condutas de adução, 1 m em condutas distribuidoras, proibições de construção/plantação junto a emissores/interceptores (artigos 12 e 13) e restrições a construções sobre coletores.(art. 12; art. 13)
  • Servidões relativas a resíduos: depósitos de resíduos proibidos a menos de 400 m dos perímetros urbanos e faixa de 400 m com restrições de uso e captações de água.(art. 14)
  • Domínio público hídrico: margens e leitos com larguras definidas (10 m, 30 m, albufeiras e perímetros de protecção de captações) e regime conforme legislação citada.(art. 15)
  • Albufeira de Alvito: zona de protecção de 500 m a contar do NPA com listas de actividades proibidas/condicionadas, zona reservada de 50 m sem construções (salvo infra‑estruturas de apoio) e exigência de tratamento de efluentes nas bacias hidrográficas.(art. 18; art. 19; art. 20)
  • Captações subterrâneas: perímetros de protecção próxima (20 m) e à distância (100 m) com listagem de usos e instalações não admitidas em cada perímetro.(art. 21; art. 22; art. 23)
  • Património edificado e arqueológico: zonas de protecção até 50 m para monumentos e imóveis de interesse público; intervenções condicionadas ao parecer do IPPAR e projectos subscritos por arquitectos em zonas classificadas; sítios arqueológicos com raio de condicionamento de 50 m.(art. 26; art. 27; art. 28; art. 29; art. 79)

Procedures and execution

Exigências procedimentais para planos, licenciamento, pareceres e conteúdos de instrumentos de gestão e projectos.

  • O Plano, a planta de ordenamento e a planta de condicionantes com este Regulamento são elementos fundamentais; cartas de aglomerados (1:5000) complementam a planta de ordenamento (art.1).(art. 1)
  • As ações que alterem o uso do solo devem respeitar o Regulamento e a planta de ordenamento; espaços urbanizáveis deverão ser objecto de planos de pormenor e planos de urbanização devem definir zonas sujeitas a planos de pormenor e de salvaguarda.(art. 2; art. 39; art. 41)
  • Planos de pormenor obrigatórios para áreas turísticas e espaços industriais propostos; planos de pormenor devem incluir projectos de arranjo de espaços exteriores e definição de características.(art. 56; art. 57; art. 66)
  • Nas operações de loteamento, cedem-se parcelase à Câmara para espaços verdes, infra‑estruturas e equipamentos conforme legislação (Decreto‑Lei 448/91 e Portaria 1182/92); Câmara pode fixar percentagem de habitação social em alvarás de loteamento.(art. 42; art. 43)
  • Intervenções em zonas de protecção de património carecem do parecer favorável do IPPAR; durante processos de classificação, terrenos/edifícios na zona de protecção não podem ser alterados sem autorização do IPPAR.(art. 27; art. 28)
  • Licenciamento municipal exigido para arborizações com espécies de crescimento rápido e para acções de destruição do revestimento vegetal ou alterações de relevo não destinadas a fins agrícolas.(art. 91; art. 92)

Frequently asked questions

Can one build on rustic land in Cuba?

Not automatically. New housing on rustic land is as a rule tightly restricted and, in agricultural or forest classes, often prohibited — unless the Cuba PDM makes an exception (rural settlement, a house tied to a farm, rural tourism, reconstruction of a pre-existence). RAN, REN, protected areas, flood zones or rural fire hazard can still block what the PDM would admit. A listing that says “construction is possible” does not replace the map or a PIP at the Câmara Municipal.

Is this PDM in force?

The operativity shown here comes from the ingested legal instrument, not from the status of a revision procedure. Always confirm in the official source.

How does one know the class of a specific plot?

These pages describe the concelho. The caderneta predial is not enough: «prédio rústico» in the tax register is not «solo rústico» in the PDM. Use Explore with the exact point, cross it with the regulation and, for a concrete proposal, file a PIP with the Câmara Municipal of Cuba.

What can I build on a plot in Cuba?

It depends on the plot's land class on the zoning map and on the rules in the Cuba PDM regulation. On urban land, housing and other uses are admitted within the class parameters (area, height, setbacks, indices). On rustic land the use is more restricted and new housing is often conditional or prohibited. Only reading the specific plot on the map, cross-checked with the regulation and the constraints, confirms what is possible.

How much can I build on a plot in Cuba?

Building capacity — floor-area and site-coverage indices, height and setbacks — is set by the PDM regulation for the plot's land class. These pages show the per-class parameters where confirmed; for a specific plot those values are confirmed on the map and in the regulation and, formally, through a pedido de informação prévia (PIP) to the Cuba Câmara.

What is the difference between urban and rustic land in Cuba?

Urban land is meant for urbanisation and building; rustic land protects agricultural, forest, natural or risk uses, and building is exceptional. A plot may be either in the PDM, regardless of what the caderneta predial says. The concrete class is read from the zoning map, not the tax register.

What are the most common constraints in Cuba?

The constraints with most weight are the National Agricultural Reserve (RAN), the National Ecological Reserve (REN), Natura 2000 areas, flood zones and rural fire hazard. This page shows the percentage of each over Cuba where cartography allows — otherwise it omits the figure rather than inventing one.

How do I file a pedido de informação prévia (PIP) with the Cuba Câmara?

The PIP is filed with the Câmara Municipal of Cuba, as a rule at the urbanism desk or the municipal portal, identifying the property and describing the proposal. The reply states whether the works are viable and under which parameters. It is the formal way to confirm what can be built before committing to a deal or a project.

Can I legalise or rebuild a house on rustic land in Cuba?

A building with proven legal existence may, depending on the Cuba PDM, be rehabilitated or reconstructed under conditions sometimes more accessible than a wholly new build. Legalising works without a permit depends on the regulation and the applicable constraints. Always confirm with the Câmara, preferably through a PIP.

How is rustic land reclassified as urban in Cuba?

Reclassifying rustic land as urban is a decision of the Câmara Municipal within the plan, subject to strict RJIGT conditions (since 2025, as a rule contiguity with urban land and an affordable or public-housing component). It is not a landowner's right, nor is it obtained through an individual building request.
