Definitions and land classification

O Regulamento delimita três classes de espaço no concelho e define subzonas e perímetros urbanos para efeitos de licenciamento.

  • O PDM divide o concelho em três classes de espaço: área urbana e urbanizável, área rural e área de salvaguarda estrita; inclui ainda subzona de 'construção condicionada' e perímetros urbanos dos aglomerados.(art. 1; art. 2; art. 6; art. 17)

Uses and land classes

O Regulamento estabelece usos preferenciais por classes de espaço, admitindo outros usos quando compatíveis e sujeitos a condicionamentos específicos.

  • Na área urbana e urbanizável o uso preferencial é residencial, comercial e de serviços, sendo admitida indústria compatível com o uso principal e a legislação aplicável.(art. 7)
  • Existem áreas preferenciais para indústria identificadas nas cartas, incluindo loteamento industrial; indústrias existentes e alterações estão reguladas por classes (A, B, C) e pareceres/condições do município.(art. 14)
  • A subzona 'construção condicionada' destina-se à transição urbano‑rural e admite moradia unifamiliar isolada, podendo admitir equipamentos ou unidades industriais compatíveis, com áreas mínimas específicas.(art. 17)
  • Na área rural o uso preferencial é mata, agricultura e floresta; não é vocacionada para urbanização ou construção, salvo exceções e condições previstas (artigos 20, 22, 23).(art. 19; art. 20; art. 22; art. 23)
  • Em áreas de salvaguarda estrita (RAN/REN) aplica‑se a legislação específica e o licenciamento municipal só é admitido se não contrariar o capítulo relativo à área rural.(art. 26; art. 27; art. 28)

Building capacity and parameters

O Regulamento fixa parâmetros de lote, densidade, cérceas, afastamentos, áreas de anexos e estacionamento, variando por contexto urbano e rural.

  • Preenchimento de falhas: lotes, tipologias, alinhamentos e cérceas seguem o predominante na testada de 100 m; não se pode invocar edifício(s) que excedam a altura predominante.(art. 8)
  • Onde não existam precedentes, edificação sujeita a plano de pormenor/loteamento e parâmetros: densidade máxima 65 fogos/ha (zonas densificadas da cidade com bloco multifamiliar e comércio/serviços até 15% da área) e 20 fogos/ha (periferia e aglomerados rurais); cércea máxima cinco pisos.(art. 8)
  • Não se admitem construções habitacionais nas traseiras de lotes nem divisão do lote no sentido da profundidade.(art. 8)
  • Afastamentos: obedecem ao RGEU; afastamento lateral é metade do valor do RGEU, com mínimo de 3 m para moradia isolada/geminada em casos de precedentes que impossibilitem alternativa, desde que sem vãos habitacionais nessas fachadas.(art. 9)
  • Fachadas cegas só permitidas como parede de encosto ou quando precedentes edificados em malhas antigas tornam inviável a regra.(art. 9)
  • Anexos: área máxima limitada ao menor entre 45 m² por fogo e 6% da área do lote; terão obrigatoriamente um só piso; muros de meação não devem resultar em >4 m de altura.(art. 10)
  • Estacionamento: regras mínimas dentro do lote (ex.: 1 lugar por fogo; 1 lugar/50 m² escritórios e indústria; 1 lugar/50 m² comercial quando área >400 m²; 0,8 lugares/quarto em unidades hoteleiras), com regimes específicos para loteamentos e possibilidades de isenção em casos justificáveis.(art. 11)
  • Na área rural a construção só é permitida em parcelas com área ≥5000 m² (exceto anexos agrícolas com 1400 m²), com regras específicas para restauro/ampliação (máx. 50% da área inicial) e condicionamentos arqueológicos.(art. 22)

Constraints and easements

O Regulamento integra diversas condicionantes legais e cartografia de servidões que condicionam licenciamento, incluindo RAN/REN, servidões específicas e protecções diversas.

  • As cartas de condicionantes incluem RAN, REN e outras servidões; o licenciamento em RAN/REN sujeita‑se à legislação específica e a pareceres dos organismos tutelares.(art. 1; art. 26; art. 27; art. 28)
  • São enunciadas várias servidões e protecções transcritas na carta de condicionantes (vizinhança de vias rodoviárias e férreas, linhas de tensão, domínio público hídrico, cursos de água, barragens, pedreiras, edifícios escolares, imóveis classificados, regime florestal, áreas áridas, entre outras).(art. 29)
  • Na área rural aplica‑se normativa restritiva: proibição de loteamentos e destaque apenas para lotes com área >5000 m² garantindo unidades de cultura; infra‑estruturas individuais obrigatórias e impossibilidade de soluções individuais pode inviabilizar obras.(art. 20; art. 24)
  • Em casos de vestígios arqueológicos e numa envolvente de 50 m, o licenciamento depende do parecer favorável dos serviços de arqueologia do IPPAR.(art. 22)

Procedures and execution

O Regulamento define regras de instrução de pedidos, deliberações e unidades operativas de planeamento e gestão, além de revogações e vigência temporária do PDM.

  • Para pedidos de licenciamento, informação prévia ou loteamentos é exigida planta com limites exactos da parcela sobre extracto aerofotogramétrico ou planta topográfica e identificação predial conforme registo.(art. 30)
  • A deliberação sobre pedidos de informação prévia depende do completo esclarecimento da área/situação do terreno e da descrição predial ou inscrição matricial solicitada ao requerente.(art. 30)
  • Unidades operativas de planeamento e gestão propostas incluem planos de pormenor de salvaguarda para o centro histórico e núcleos (Pinhel, Cidadelhe, Aldeia), carta de ordenamento específico para Pinzio e projectos de requalificação urbana.(art. 34)
  • O Regulamento revoga anteriores planos e regulamentos de igual ou inferior hierarquia que contrariem as presentes disposições; tem vigência de 10 anos, devendo ser revisto antes desse prazo.(art. 4; art. 31)
  • Durante a vigência admite‑se acerto pontual dos limites da área urbana e urbanizável por cadastro, desde que cumulativamente preenchidos critérios de contiguidade, infra‑estruturas, ausência de interferência com salvaguardas e limites de dimensão.(art. 32)

Can one build on rustic land in Pinhel?

Not automatically. New housing on rustic land is as a rule tightly restricted and, in agricultural or forest classes, often prohibited — unless the Pinhel PDM makes an exception (rural settlement, a house tied to a farm, rural tourism, reconstruction of a pre-existence). RAN, REN, protected areas, flood zones or rural fire hazard can still block what the PDM would admit. What can I build on a plot in Pinhel?
