Can I build on rustic land in Mêda?

About 98% of the territory of Mêda is rustic land. That does not mean one may never build, but new housing is as a rule tightly restricted and often prohibited unless the PDM makes an exception (rural settlement, a farmhouse, reconstruction). RAN, REN, protected areas, flood zones or rural fire hazard can still block what the plan would admit. Uses and land classes

O regulamento tipifica usos dominantes, complementares e compatíveis por categorias e subcategorias de solo, indicando expressamente quais são aplicáveis a cada caso.

  • Define usos dominantes, complementares e compatíveis e prevê a possibilidade de usos especiais sujeitos a condições (tipificação dos usos).(art. 12)

Building capacity and parameters

O plano fixa índices de utilização, alturas máximas, número de pisos e outros parâmetros por categorias e subcategorias, bem como regras para cálculo da área de construção.

  • Regime especial para empreendimentos estratégicos: aplicação dos parâmetros correspondentes ou majoração até 50% em solo rústico se a Câmara entender viável; possibilidade de dispensa de outros parâmetros fora de certas categorias.(art. 71)

Constraints and easements

O regulamento integra e dá prevalência a servidões, restrições e instrumentos supramunicipais, identificando numerosos condicionantes ambientais, patrimoniais e infraestruturais.

  • Servidões administrativas e restrições de utilidade pública aplicam‑se e prevalecem quando mais restritivas; anexo II e planta de condicionantes identificam as incidências.(art. 4; art. 102)
  • Articulação com instrumentos supramunicipais: PSRN2000 (anexo III) e PROF-CI (anexo IV) condicionam usos e gestão, em especial para RN2000 e espaços florestais.(art. 5; art. 21)

O plano disciplina procedimentos para reclassificações, reconhecimento de empreendimentos estratégicos, execução por UOPG e mecanismos perequativos, bem como exigências de documentação técnica e pareceres.

  • Reclassificação de solo rústico em urbano segue o RJIGT e exige demonstração de necessidade, oportunidade e viabilidade, cumprimento de contiguidade (com exceções), ligação a infraestruturas e parâmetros de edificabilidade definidos (artigo 11).(art. 11)
  • Empreendimentos de interesse estratégico: procedimento de pedido, relatório técnico, apreciação pela Câmara, discussão pública e deliberação da Assembleia Municipal; decisão condiciona tramitação subsequente (artigos 69‑70).(art. 69; art. 70)
  • UOPG: identificação na planta e execução segundo conteúdos programáticos e instrumentos previstos no anexo VI; até à sua regulamentação aplicam‑se as demais disposições do plano (artigo 80).(art. 80)

  • Adota conceitos técnicos de ordenamento e urbanismo (piso de edifício, cota de soleira, fachada, altura da fachada, entre outros) e define expressões como viabilização, varanda, terraço, área coberta, índice de área coberta, via pública habilitante, colmatação, frente urbana, ETI e NDT.
  • Classificação básica do solo em solo urbano e solo rústico e subcategorias detalhadas para cada uma (artigo 10).(art. 10)

Can one build on rustic land in Mêda?

Not automatically. New housing on rustic land is as a rule tightly restricted and, in agricultural or forest classes, often prohibited — unless the Mêda PDM makes an exception (rural settlement, a house tied to a farm, rural tourism, reconstruction of a pre-existence). What can I build on a plot in Mêda?

It depends on the plot's land class on the zoning map and on the rules in the Mêda PDM regulation. On rustic land the use is more restricted and new housing is often conditional or prohibited.
