Definitions and land classification

O regulamento define termos técnicos, índices e categorias de solo e usos para aplicação no PDM, servindo de referência para interpretação das demais normas.

  • Adopção de definições e abreviaturas relativas a atividade agrícola, edificabilidade, índices (Iu, Iimp), lote, parcela, tipos de obras, UOPG, entre outras que regem o PDM.(art. 5)
  • Classificação do solo em Solo Urbano e Solo Rural e identificação de categorias e subcategorias para cada um (ex.: Espaços Centrais, Residenciais, Florestais, Agrícolas, Espaços Naturais, etc.).(art. 27; art. 28; art. 29)

Uses and land classes

O regulamento estabelece usos dominantes e compatíveis por categorias de solo urbano e rural, com regras específicas por subcategoria e condicionamentos quanto à compatibilidade.

  • No solo urbano, cada categoria (ex.: Espaços Centrais, Residenciais, Atividades Económicas, Verdes, Uso Especial) define usos dominantes e admite usos compatíveis como habitação, comércio, serviços, equipamentos e infraestruturas, condicionados ao regime da categoria.(art. 28; art. 30; art. 31)
  • Espaços Centrais: admitem habitação, comércio, serviços, equipamentos; atividades terciárias permitidas em todos os pisos; industriais compatíveis apenas no piso térreo ou cave.(art. 33; art. 34)
  • Espaços Residenciais: funções preferencialmente residenciais, admitindo comércio e serviços e equipamentos de interesse coletivo; tipologias e limitações dependem da subcategoria (Densidade 1 ou 2).(art. 36; art. 37)
  • Espaços de Atividades Económicas: uso dominante industrial/armazenagem/oficinas; habitação e empreendimentos turísticos em princípio não permitidos (salvo situações preexistentes).(art. 39; art. 40)
  • Solo rural: categorias (Florestais, Agrícolas, Recursos Geológicos, Naturais, Edificação Dispersa, Culturais, Ocupação Turística, Equipamentos) com usos dominantes agrícolas, florestais e naturais, admitindo usos compatíveis listados no regulamento (ex.: primeira habitação, comércio local, infraestruturas) sujeitos a proibições específicas em subcategorias sensíveis.(art. 29; art. 46; art. 47)

Building capacity and parameters

O regulamento fixa parâmetros gerais e específicos de edificabilidade (Iu, Iimp, alturas, afastamentos, áreas máximas) aplicáveis por categoria e subcategoria de solo.

  • Parâmetros comuns para usos compatíveis em solo urbano: Iu máximo 0,50; Iimp máximo 50%; altura máxima 8,5 m; altura de fachada 6 m; afastamentos mínimos segundo tipologia (ex.: 3 m para habitação unifamiliar).(art. 32)
  • Empreendimentos turísticos em solo urbano: Iu máximo 1,50 e Iimp máximo 70%, com afastamentos e afastamento ao eixo da via definidos (Art.32).(art. 32)
  • Espaços Centrais e subcategorias: parâmetros diferenciados (ex.: Centros I — Iimp até 80% no centro da vila, H até 16 m, Hf até 13 m; Centros II — Iu até 0,70, H até 13 m; Centros III — Iu até 1,50, H até 16 m), com afastamentos mínimos indicados.(art. 35)
  • Espaços Residenciais: Densidade 1 (Iu 0,70; Iimp 70%; H 10 m; Hf 7 m) e Densidade 2 (Iu 1,50; Iimp 80%; H 16 m; Hf 13 m) com afastamentos e regras de continuidade previstas.(art. 38)
  • Edificabilidade em solo rural: parâmetros por dimensão de prédio e uso (ex.: pequenas construções de apoio agrícola com áreas máximas consoante a área do prédio; pecuária até Ac 2500 m² e H até 10 m; estufas e poços com afastamentos específicos).(art. 48)
  • Áreas de Edificação Dispersa: limites de Ac totais e por tipologia (ex.: Ac total 350 m²; habitação unifamiliar isolada Ac 250 m²; Iimp máximo 60%; H máximo 11 m) e afastamentos mínimos.(art. 62)
  • Espaços de Atividades Económicas e Equipamentos: parâmetros específicos (Iimp até 80% em muitos casos; H e Hf máximas e afastamentos mínimos conforme artigos aplicáveis).(art. 41; art. 45)

Constraints and easements

O regulamento identifica servidões, reservas e áreas protegidas que condicionam usos e obras, e fixa regimes de proteção e pareceres prévios vinculativos para intervenções nessas áreas.

  • Identificação das servidões e restrições de utilidade pública relativas a recursos hídricos, geológicos, agrícolas (RAN), ecológicos (REN), património edificado e infraestruturas, a constar na Planta de Condicionantes.(art. 6; art. 3)
  • RAN: delimitação segundo capacidade agrícola; áreas non aedificandi, destinadas à atividade agrícola; utilizações não agrícolas só quando não exista alternativa fora da RAN e sujeitas a parecer prévio vinculativo da Secretaria Regional competente.(art. 8; art. 9; art. 11)
  • REN: delimitação inclui ZECs e Parque Natural; nas áreas REN aplicam-se regimes legais e operações urbanísticas sujeitas a parecer prévio vinculativo da Secretaria Regional competente.(art. 13; art. 14)
  • Património edificado classificado e de interesse municipal com zonas especiais de proteção; intervenções sujeitas a vistoria, preservação de fachadas e pareceres (inclui património arqueológico com acompanhamento e comunicação à DRAC/CMPS).(art. 15; art. 16; art. 18)
  • Proteções a infraestruturas (captações, reservatórios, condutas, coletores, redes hidroagrícolas) com faixas non aedificandi, proibições e exigência de pareceres vinculativos das entidades gestoras; faixas e distâncias especificadas (ex.: 20 m para proteção imediata de captações, 10 m/100 m para reservatórios/ETAs/ETARs conforme o caso).(art. 19; art. 20; art. 21)
  • Risco natural: Planta Indicativa do Risco identifica suscetibilidades; em áreas de Suscetibilidade Elevada qualquer intervenção urbanística depende de estudo técnico-científico integrado e pareceres; faixas non aedificandi de 10 m a partir de zonas de suscetibilidade elevada.(art. 25; art. 26)
  • Classificação acústica: delimitação de Zonas Sensíveis e Mistas e obrigação de reclassificação em Planos de Urbanização/Pormenor e elaboração de planos de redução de ruído quando níveis legais são ultrapassados.(art. 23; art. 24)

Procedures and execution

O regulamento estabelece instrumentos de planeamento e execução (UOPG, Planos de Urbanização/Pormenor), exigências de pareceres, estudos técnicos e autorizações específicas conforme a matéria e condicionantes.

  • Delimitação e priorização de Unidades Operativas de Planeamento e Gestão (UOPG) cuja execução obriga à elaboração de Planos de Urbanização ou de Pormenor com objetivos programáticos específicos para cada UOPG identificada.(art. 85; art. 86; art. 87)
  • Execução do plano por sistemas de compensação, cooperação ou imposição administrativa; unidades de execução e instrumentos de execução previstos (ex.: expropriação, reparcelamento) e requisito de programas de ação territorial.(art. 78; art. 79; art. 82)

Frequently asked questions

Can one build on rustic land in Ponta do Sol?

Not automatically. New housing on rustic land is as a rule tightly restricted and, in agricultural or forest classes, often prohibited — unless the Ponta do Sol PDM makes an exception (rural settlement, a house tied to a farm, rural tourism, reconstruction of a pre-existence). RAN, REN, protected areas, flood zones or rural fire hazard can still block what the PDM would admit. A listing that says “construction is possible” does not replace the map or a PIP at the Câmara Municipal.
