Can I build on rustic land in Mação?

About 97% of the territory of Mação is rustic land. That does not mean one may never build, but new housing is as a rule tightly restricted and often prohibited unless the PDM makes an exception (rural settlement, a farmhouse, reconstruction). RAN, REN, protected areas, flood zones or rural fire hazard can still block what the plan would admit. Definitions and land classification

Define a área abrangida pelo PDM, os elementos constituintes do Plano e plantas anexas, e delimita a RAN e REN segundo a planta de condicionantes.

  • O PDM abrange toda a área do concelho de Mação conforme a planta de ordenamento 1:25 000.(art. 1)

Uses and land classes

Estabelece usos permitidos, proibidos e exceções em áreas de RAN e REN, com condições e necessidade de pareceres em certos casos.

  • Os solos da RAN devem ser exclusivamente afectos à agricultura, sendo proibidas ações que diminuam ou destruam potencialidades agrícolas (ex.: obras, deposição de resíduos, aterros, erosão, uso indevido de fertilizantes, modificações pedológicas).(art. 6)
  • O regulamento lista exceções à proibição na RAN sujeitas a parecer favorável da Comissão Regional da Reserva Agrícola (ex.: obras agrícolas integradas, habitações para fixação de agricultores, vias públicas sem alternativa, exploração de minas com plano de recuperação, obras arqueológicas, operações florestais, instalações de agro‑turismo e campos de golfe declarados de interesse turístico nas condições previstas).(art. 7)
  • Na REN são proibidas operações de loteamento, obras de urbanização, vias, construção de edifícios, aterros, destruição do coberto vegetal e obras hidráulicas, com exceções para operações florestais aprovadas e outras previstas no Decreto‑Lei citado.(art. 10; art. 11)
  • A plantação ou replantação de espécies de crescimento rápido nas áreas de RAN e REN é proibida ou condicionada conforme a Portaria referida, com distâncias específicas para géneros indicados.(art. 8; art. 12; art. 13)

Building capacity and parameters

Fixam‑se faixas non aedificandi e distâncias mínimas de proteção para estradas, ferrovias, vias municipais, infra‑estruturas sanitárias, pedreiras e domínio público hídrico.

  • Para itinerários principais (IP) em rede fundamental aplicam‑se zonas non aedificandi de 200 m para cada lado do eixo desde o estudo prévio até à planta parcelar (posteriormente seguem limites do artigo seguinte).(art. 15)
  • Para a rede nacional a desclassificar definem‑se zonas non aedificandi medidas a partir da plataforma: 10 m para edifícios de habitação em zonas com visibilidade e 50 m para instalações industriais, hotéis, igrejas e outros conforme o caso.(art. 18)
  • Estradas e caminhos municipais têm faixas non aedificandi de 8 m e 6 m, respectivamente, medidas a partir da plataforma; restantes vias públicas fora de aglomerados têm faixas de 5 m.(art. 18)
  • As áreas de proteção às novas vias urbanas definem distância mínima entre fachadas como a largura da faixa de circulação mais 2,5 m para cada lado, sendo a distância mínima entre fachadas 10 m na ausência de planos específicos.(art. 20)
  • Para infra‑estruturas ferroviárias definem‑se faixas non aedificandi de 10 m para cada lado da linha medidas a partir do talude ou linha a 4 m da aresta exterior do carril; é interdita construção de edifícios industriais a menos de 40 m.(art. 21)
  • Servidões da rede eléctrica incluem perímetros de proteção, sendo definido um raio de 100 m em redor de centrais de produção.(art. 23)
  • Ao longo das condutas de água e emisários de drenagem fora de aglomerados é interditada construção e plantação de árvores numa faixa de 5 m para cada lado; reservatórios têm faixa de 10 m sem construções.(art. 24)
  • Definem‑se faixas non aedificandi de 400 m aos limites de aterros sanitários e estações de tratamento de águas residuais, com proibição de captações de água nessas faixas.(art. 25)
  • Para pedreiras aplica‑se zona de defesa de 10 m a 100 m a partir do limite da exploração conforme legislação específica.(art. 26)
  • Nos leitos e margens de linhas de água e numa faixa de 10 m para cada lado é interdito implantar edifícios, destruir revestimento vegetal ou instalar depósitos; autorizações excecionais dependem de parecer do Instituto da Água.(art. 28)

Estabelece procedimentos de aprovação, revisão, pareceres técnicos e documentação integrante do Plano, bem como exigência de pareceres para exceções em zonas protegidas.

What can I build on a plot in Mação?

It depends on the plot's land class on the zoning map and on the rules in the Mação PDM regulation.
