Can I build on rustic land in Alter do Chão?

Definitions and land classification

O regulamento define categorias de solo e tipologias, bem como conceitos para efeitos de aplicação do PDM.

  • Define 'assentos de lavoura', 'empreendimentos turísticos isolados', 'instalação de apoio a atividades ambientais', 'núcleos de desenvolvimento turístico' e usos compatíveis, entre outras definições específicas.(art. 5)
  • Classifica o solo em solo rústico e solo urbano e identifica ainda a Estrutura, Sistema Agrícola, Infraestruturas Urbanas, Áreas de Risco e outros sistemas com regimes próprios.(art. 9)

Uses and land classes

O regulamento especifica, por categoria de espaço, os usos admitidos, compatíveis e condições de admissão para equipamentos, indústria, turismo, habitação e atividades agrícolas/florestais.

  • Espaços de equipamentos admitem equipamentos de utilização coletiva, turismo (hoteis rurais, turismo no espaço rural), comércio e restauração de apoio às atividades locais, com regras específicas de projeto.(art. 37; art. 38; art. 52; art. 53)
  • Espaços verdes permitem apenas usos de recreio e lazer compatíveis com preservação; admitindo-se quiosques/esplanadas, restauração limitada e equipamentos de lazer com áreas e parâmetros máximos.(art. 54; art. 55)
  • Espaços centrais destinam-se a habitação, comércio e serviços, manutenção da função habitacional e condicionam intervenções que alterem a malha ou usos prioritários.(art. 42; art. 43)

Building capacity and parameters

O regulamento fixa parâmetros de edificabilidade por tipo de espaço (área máxima de implantação, altura de fachada, número de pisos, índices de ocupação/impermeabilização) em quadros específicos e regras para ampliações.

O regulamento identifica condicionantes de âmbito ambiental, patrimonial, de risco e de infraestruturas, aplicando servidões, faixas de proteção e normas específicas.

Procedures and execution

O regulamento determina a composição do PDM, instrumentos de gestão a elaborar e princípios para execução/urbanização, incluindo planos de execução para unidades de obra e necessidade de pareceres e autorizações específicas.

  • O PDM integra o Regulamento, Planta de Ordenamento e várias Plantas de Condicionantes e Reservas que servem de base para decisões e instrumentos de gestão (art. 3.º).(art. 3)
  • O Município deve elaborar Planos de Urbanização, Planos de Pormenor e Planos de Execução/Unidades de Execução para as U1, U2 e outras UOPG, conforme indicado, e há obrigação municipal de elaborar PMP para U3 quando previsto (artigos 82.º–83.º).(art. 82; art. 83)
