Uses and land classes

O regulamento descreve usos admitidos ou condicionados por categorias de solo (agrícola, florestal, industrial, turístico, urbano), detalhando atividades possíveis e condicionamentos em cada categoria.

  • Espaços agrícolas: priorizam produção agrícola, culturas temporárias e permanentes; em RAN condicionam-se cultivos e práticas (p.ex. orientadas para florícolas) e proibem-se certas ocupações e efluentes sem tratamento; admitidas atividades agropecuárias e apoio rural quando compatíveis.(art. 23; art. 34; art. 27)
  • Espaços florestais: distinguem-se produção e conservação, privilegiando espécies autóctones, silvicultura adequada, apelos à gestão anti-incêndio e restrições a intervenções que prejudiquem valores ecológicos.(art. 37; art. 40)

Building capacity and parameters

O Regulamento fixa parâmetros de edificabilidade em diferentes contextos (rústico, equipamentos, urbano), incluindo índices, alturas máximas, áreas e regras para pequenas construções e ampliações.

  • Em solo rústico (ex.: construções agrícolas/apoio): índice de construção referido de 0,05; construção normalmente limitada a dois pisos; cércea máxima citada de 6,5 m; e área máxima de construção de 40 m2 para certas construções de apoio.(art. 29)
  • Espaços de equipamentos e outras estruturas: capacidade edificatória e índices de ocupação referidos para reconversão, ampliação ou nova edificação, devendo garantir enquadramento paisagístico.(art. 75)
  • Cedências e condicionamento de loteamento: parâmetros de cedência, áreas mínimas para espaços verdes (parcelas mínimas de 300 m2 ou 500 m2 conforme o caso) e requisitos de estacionamento por uso (habitação, comércio, hotéis).(art. 98)
  • Espaços verdes: limites de impermeabilização e condicionamentos para construções novas e intervenções, com índices máximos aplicáveis às áreas de recreio e lazer.(art. 90)

Constraints and easements

O Plano identifica servidões, restrições e áreas protegidas que condicionam usos e intervenções no território, incluindo elementos naturais, patrimoniais, riscos e infraestruturas.

  • Servidões e restrições de utilidade pública: identificação de Recursos Naturais (REN, RAN, Rede Natura 2000, Monumento Natural), recursos hídricos, geológicos e agrícolas, áreas percorridas por incêndios e redes de faixas de gestão.(art. 7)
  • Servidões administrativas e regime: servidões e restrições aplicam‑se no território municipal e prevalecem as normas de utilidade pública previstas na legislação, com carta de condicionantes complementar e reportes a entidades competentes (PMDFCI).(art. 8)
  • Património cultural e arqueológico: património construído e arqueológico inventariado integra a planta de património; intervenções sujeitas ao regime legal de proteção e a condicionamentos específicos.(art. 9; art. 10)
  • Infraestruturas e redes: identificação de redes rodoviárias (principal, distribuidora, local), abastecimento de água, drenagem, rede elétrica, gasodutos e condicionamentos de proteção associados.(art. 18; art. 20)
  • Risco e incêndio: áreas de Classe de Risco de Incêndio (alta/muito alta) e redes de faixas de gestão representadas na Carta de Condicionantes, com atualização conforme PMDFCI e entidades competentes.(art. 7; art. 8)

O regulamento descreve instrumentos, documentos de suporte e mecanismos de execução do Plano, incluindo UOPG, estudos e mecanismos de perequação.

  • Composição do PDM e documentos exigidos: o PDM integra Regulamento, Plantas (Ordenamento, Património, Condicionantes) e vários estudos e relatórios (Relatório de Ordenamento, Ambiental, Programa de Execução, Carta da Estrutura Ecológica, Carta Arqueológica, entre outros).(art. 4)

Definitions and land classification

O regulamento define categorias de solo e conceitos estruturantes do PDM, remetendo para plantas e relatórios integrados no plano.

  • Composição e definição do Plano: o PDM é constituído pelo Regulamento, Plantas de Ordenamento (Geral e Património), Planta de Condicionantes e um conjunto de estudos e relatórios que enquadram a gestão territorial.(art. 4)

Can one build on rustic land in Nisa?

Not automatically. New housing on rustic land is as a rule tightly restricted and, in agricultural or forest classes, often prohibited — unless the Nisa PDM makes an exception (rural settlement, a house tied to a farm, rural tourism, reconstruction of a pre-existence). RAN, REN, protected areas, flood zones or rural fire hazard can still block what the PDM would admit. A listing that says “construction is possible” does not replace the map or a PIP at the Câmara Municipal.

What can I build on a plot in Nisa?

It depends on the plot's land class on the zoning map and on the rules in the Nisa PDM regulation.
