Can I build on rustic land in Portalegre?

Definitions and land classification
O regulamento define classes de solo e termos usados para gestão do território, distinguindo solo rústico e solo urbano e identificando subcategorias e perímetros.

Uses and land classes
O regulamento especifica, por categorias de solo e subcategorias, os usos admissíveis e condicionados, incluindo atividades agrícolas, industriais, turísticas e equipamentos, com regras específicas em áreas protegidas e no Parque Natural.
- No Parque Natural da Serra de S. Mamede listam-se usos admitidos e proibidos, como loteamento, indústrias de carvão (com condicionantes), explorações agropecuárias, e cortes de copas, sujeitando várias ações a pareceres.(art. 5)
- Em espaços agrícolas e agrícolas preferenciais há objetivação de preservação da capacidade produtiva e são definidas construções e usos admitidos (habitação rural, turismo no espaço rural) com condicionamentos de dimensão mínima de prédios e áreas máximas de construção.(art. 18; art. 19; art. 21)
- Espaços florestais, silvopastoris e montados detalham usos compatíveis, admitindo empreendimentos de turismo no espaço rural, instalações industriais vinculadas à produção primária em condições específicas e limitações de pisos e Io.(art. 23; art. 26; art. 27)
- No solo urbano identificam-se espaços centrais, habitacionais (alta/média/baixa densidade), espaços de atividades económicas e de equipamentos, com usos compatíveis referentes a comércio, serviços, indústria e turismo quando compatíveis.(art. 52; art. 53)
- Usos em áreas integradas na Rede Natura 2000 estão sujeitos a restrições específicas (por ex. proibição de ações que perturbem espécies protegidas; certas instalações ou energias sujeitas a parecer vinculativo).(art. 44)
Building capacity and parameters
O regulamento fixa índices e parâmetros diferenciados por tipologia urbana, zonas industriais, espaço para grandes equipamentos e espaços rurais, incluindo Io, número máximo de pisos, alturas e áreas máximas em determinadas situações.
- No solo urbano através de loteamento aplicam-se índices máximos por categorias (ex.: Io e número máximo de pisos para várias densidades), com valores e níveis indicados nas secções de edificabilidade.(art. 54; art. 53)
- Zonas industriais (ex.: Monte Paleiros) têm Io e altura máxima da fachada especificadas (por exemplo Io = 0,5 e altura máxima 9 m para Monte Paleiros).(art. 56)
- O espaço para grandes equipamentos exige plano de urbanização ou pormenor para execução e fixa Io, Iu e número máximo de pisos (ex.: Io máximo 0,75 e até 6 pisos para determinados equipamentos).(art. 59)
- Em espaços rurais (agrícolas, florestais) existem limites à área de implantação, área total de construção, índices de impermeabilização e número máximo de pisos, com valores mínimos/máximos referidos para casos de turismo e reconstrução.(art. 21; art. 26; art. 30)
Constraints and easements
O regulamento identifica condicionantes de utilidade pública, áreas protegidas (Parque Natural, REN, RAN, Rede Natura), servidões e imposições legais que enquadram usos e intervenções, com exigência de pareceres em vários casos.
- Lista servidões e restrições de utilidade pública aplicáveis ao território municipal (infraestruturas, corredores rodoviários, entre outros) e remete para legislação aplicável para regimes particulares.(art. 7)

Procedures and execution
O regulamento prevê instrumentos de gestão, Unidades Operativas de Planeamento e Gestão (UOPG), exigência de planos de urbanização/pormenor para certas execuções e condiciona entradas em vigor e revisão do PDM.
