Definitions and land classification

O regulamento classifica e define tipos de solo e conceitos básicos para aplicação das normas urbanísticas.

  • Define indicadores e conceitos como afastamento mínimo, aglomerado urbano e rural, altura total da construção, área de construção, implantação e impermeabilização, cércea.(art. 5)

Uses and land classes

O regulamento descreve que usos são admitidos ou prioritários por classes de solo, com regras específicas por categoria.

  • Espaço de Equipamento: destina-se a equipamentos públicos e serviços coletivos, com usos e edificações afetas à provisão de serviço público ou coletividades; limites e normas definidos em plantas de ordenamento.(art. 12)
  • Espaço de Urbanização Programada: destinado ao desenvolvimento urbano e de serviços (incluindo turismo e atividades compatíveis), com índices e parâmetros próprios.(art. 13)
  • Espaço Industrial e Empresarial: admite instalações industriais, logística, comércio e serviços de apoio, sujeitos a condicionantes ambientais e a necessidade de enquadramento por projeto ou Plano de Pormenor.(art. 14; art. 15)
  • Estrutura Verde Urbana: inclui espaços verdes urbanos, integração de infraestruturas, ribeiras, património e áreas de valor paisagístico, destinados a funções ecológicas, recreio e lazer.(art. 16)
  • Espaços Agrícolas (diversas subcategorias): usos privilegiados para agricultura, agroindústria e atividades de apoio, com restrições ao loteamento e regras específicas de edificação e estudo prévio.(art. 17; art. 18; art. 19; art. 20)
  • Espaço Florestal de Proteção/Recuperação: destinado à proteção e recuperação de formações como Sobro/Azinheira, com objetivos de ordenamento e proibição de loteamento.(art. 21)
  • Espaço de Atividade Extrativa: inclui áreas de exploração licenciada (pedreiras/minas) com regras sobre operações, impactes e condicionantes ambientais e de ordenamento.(art. 22)
  • Espaço Cultural: abrange áreas com património inventariado/classificado; privilegia-se a preservação e intervenções com autorização das entidades competentes e integração em UOPG.(art. 23; art. 24)
  • Empreendimentos Turísticos: devem respeitar indicadores do espaço urbano/urbano rural, com limites de pisos e exigência de estudos que considerem preservação ambiental e paisagística.(art. 25; art. 26)
  • Espaço Logístico: destinado a actividades de transporte e armazenagem (ex.: Herdade da Comenda), com necessidade de Plano de Pormenor para implementação e condicionantes infraestruturais.(art. 29; art. 30)

Building capacity and parameters

O regulamento fixa parâmetros gerais de edificabilidade, índices e limites aplicáveis por categoria de espaço, bem como regras de cércea e implantação.

  • Apresenta índices brutos máximos por densidade para espaços urbanizados (fogos/ha) e quadros de hab/ha, índice de implantação, índice de construção, pisos e cércea para espaços de urbanização programada.(art. 11; art. 13)
  • No solo agrícola preferencial, estipula um índice de construção de 0,02 (com exceções), altura máxima normalmente de 10 m e outros condicionamentos sobre acessos, abastecimento e drenagem.(art. 18)
  • Para espaços agrossilvopastoris e florestais aplicam-se índices de construção reduzidos (indicativo 0,02) e alturas máximas de 10 m, com exigência de integração paisagística e justificações técnicas.(art. 20; art. 21)
  • Os instrumentos de planeamento podem definir edificabilidade por propriedade ou conjunto, admitindo direitos de aquisição e transferência de potencialidade conforme parâmetros do plano.(art. 37)

Constraints and easements

O regulamento lista servidões, restrições e áreas protegidas que condicionam intervenções e usos no território.

  • Enumera servidões e restrições de utilidade pública como domínio público hídrico, albufeiras, indústria extrativa, RAN, Aproveitamento Hidroagrícola do Caia, REN, Rede Natura 2000, ZPE’s, imóveis classificados, infraestruturas rodoviárias/ferroviárias, redes de água e saneamento, gasoduto e infraestruturas eléctricas e militares.(art. 34)
  • Define condicionantes específicas nas áreas da Estrutura Verde (proibições de loteamento, construção, destruição do solo vivo, alteração topográfica, derrube de árvores salvo exceções), e regras para zonas de vale, faixas de proteção das albufeiras e zonas de relevo.(art. 16; art. 27)

  • Plantas de condicionantes cartografam áreas, locais e bens imóveis sujeitos a restrições (representadas na planta de condicionantes).(art. 34)

Procedures and execution

O regulamento indica os instrumentos e procedimentos de planeamento e execução, bem como exigências para licenciamento e projetos.

  • Estabelece Unidades Operativas de Planeamento e Gestão (UOPG) com instrumentos de planeamento a usar (Planos de Pormenor, Loteamento, Planos de Intervenção) e identifica UOPG específicas com a necessidade de elaboração de planos.(art. 35)
  • Determina que espaços logísticos e outros grandes empreendimentos serão objeto de Plano de Pormenor para implementação, e que o licenciamento se subordina às disposições e condicionantes do plano.(art. 30; art. 14)
  • Prevê a perequação de benefícios e encargos nas UOPG, com critérios como definição de áreas de cedência média, índice médio de afetação e repartição de encargos de infraestruturas, e remete para legislação em vigor sobre áreas de cedência e taxas municipais.(art. 36; art. 38; art. 39)
  • Refere que licenciamento, obras e ações devem respeitar instrumentos superiores (Planos de Urbanização, Planos Setoriais, PUE, POAC, planos de albufeiras) e que a alteração dos instrumentos obedece a prazos e procedimentos legais.(art. 3; art. 4; art. 31; art. 32)

Can one build on rustic land in Elvas?

Not automatically. New housing on rustic land is as a rule tightly restricted and, in agricultural or forest classes, often prohibited — unless the Elvas PDM makes an exception (rural settlement, a house tied to a farm, rural tourism, reconstruction of a pre-existence). RAN, REN, protected areas, flood zones or rural fire hazard can still block what the PDM would admit. A listing that says “construction is possible” does not replace the map or a PIP at the Câmara Municipal.

What can I build on a plot in Elvas?
