Can I build on rustic land in Sernancelhe?

Uses and land classes
O regulamento define usos dominantes e complementares por categorias de solo e indica condições de compatibilidade e exclusões específicas.
- Em aglomerados rurais, áreas de edificação dispersa e espaços rurais admitem-se comércio, restauração, apoios agrícolas, pequenas indústrias, turismo rural e exploração hidrogeológica como usos complementares.(art. 48)
- Espaços de exploração de recursos destinam-se exclusivamente à extração (pedreiras, minas) e à transformação/apoio próprio, com regras de construção e recuperação após cessação.(art. 45)
Building capacity and parameters
O regulamento fixa índices, alturas máximas e regras de integração urbanística aplicáveis por categorias de solo, bem como regras específicas para ampliações e obras em zonas protegidas.
- A edificabilidade de um prédio é determinada pelos parâmetros urbanísticos da categoria/subcategoria de espaço e condicionada por servidões e salvaguardas; não se consideram para edificabilidade áreas a ceder ao município, excepto em equipamentos (regra de cálculo).(art. 16)
- Nos espaços rurais (aglomrados e edificação dispersa) índices máximos: 0,6 (aglomerados rurais) e 0,2 (edificação dispersa) relativamente à área do prédio, com altura máxima de fachada geralmente 7 m para habitação (8 m para outras funções), admitindo-se ampliações conforme parâmetros.(art. 48; art. 51)
- Para explorações de recursos geológicos, as edificações de apoio têm altura máxima de fachada de 7 m e área de construção não superior a 0,10 da área em exploração; ampliações condicionadas e obrigação de recuperação paisagística após cessação.(art. 45)
- Nas obras que afetem a Albufeira do Vilar, a cota de cumeeira não pode exceder 1,5 m acima da cota da laje do piso; na zona de proteção há interdições de certos usos e limites à construção conforme artigo específico.(art. 8)
Constraints and easements
O Plano enumera servidões, restrições e áreas protegidas (agua, RAN, REN, Rede Natura, património, redes de defesa) e define regimes específicos para cada uma.
- A Albufeira do Vilar tem zona terrestre de proteção e zona reservada (500 m); em zonas de proteção são proibidas certas instalações, extração de inertes e explorações pecuárias intensivas, além de regras específicas para acessos e caminhos marginais.(art. 8)
Procedures and execution
O regulamento descreve os elementos do Plano, documentos de acompanhamento e previsão de execução e unidades de execução, prevendo instrumentos e procedimentos para a execução das UOPG.
- O PDM é composto pelo Regulamento, plantas de ordenamento e condicionantes e por relatórios e estudos de suporte (relatório ambiental, relatório Rede Natura, programa de execução, plano de financiamento, planta de património, ficha estatísticas, entre outros) que acompanham o PDMS.(art. 3)
