Uses and land classes

O regulamento qualifica usos conforme categorias de espaço e indica ocupações e utilizações admitidas em vários capítulos, incluindo espaços naturais, espaços de exploração e solo urbano.

  • Os Espaços Naturais integram valores naturais e paisagísticos e destinam-se à conservação da natureza, com ocupações que promovam manutenção e recuperação do estado de conservação da flora e fauna e do património natural.(art. 1)

Building capacity and parameters

O regulamento estabelece regimes de edificabilidade específicos por subsecção e por categoria de solo, remetendo para quadros e artigos que detalham parâmetros por tipo de área.

Constraints and easements

O PDM identifica servidões administrativas e outras condicionantes (recursos hídricos, geológicos, agrícolas, ecológicos, património e infraestruturas) e estabelece que o uso do solo se rege por esses regimes legais.

Procedures and execution

O regulamento define instrumentos de programação, mecanismos de execução e compensação, e regras para cedências e unidades operativas de planeamento e gestão.

  • Os instrumentos de programação incluem Plano de Urbanização, Plano de Pormenor e Unidade de Execução, e o solo é dividido para execução em solo urbanizado e solo urbanizável, com regras específicas de execução e cedências.(art. 101; art. 103)
  • Os mecanismos de compensação e perequação compensadora aplicam-se nas Unidades Operativas de Planeamento e Gestão, com determinação de índices médios de utilização e áreas de cedência média para efeitos de repartição de custos de urbanização.(art. 105; art. 106)
  • As Unidades Operativas de Planeamento e Gestão (UOPG) são delimitadas pelo município para operacionalizar a execução e incluem objetivos e regulamentação específicos.(art. 108)

O regulamento adopta definições para tipologias turísticas e classifica o solo em Solo Rural e Solo Urbano, com conceitos complementares para usos e elementos territoriais.

Can one build on rustic land in Porto de Mós?

Not automatically. New housing on rustic land is as a rule tightly restricted and, in agricultural or forest classes, often prohibited — unless the Porto de Mós PDM makes an exception (rural settlement, a house tied to a farm, rural tourism, reconstruction of a pre-existence). RAN, REN, protected areas, flood zones or rural fire hazard can still block what the PDM would admit.
