Can I build on rustic land in Almeirim?

O regulamento distingue que usos são admitidos em áreas rurais, de proteção e nas zonas sujeitas a risco de inundações; explica também usos especiais (agroindústria, turismo, infraestruturas ligadas à água e projetos estratégicos).

  • Áreas rurais — uso geralAs áreas rurais destinam‑se principalmente a explorações agrícolas, florestais e silvopastoris, sendo em regra proibido o loteamento urbano; podem existir atividades agroindustriais desde que licenciadas.(art. 6)

Building capacity and parameters

O regulamento fixa onde e quanto se pode construir, com regras para áreas rurais, agroindustriais e limites de altura, implantação e índices de construção; no caso de cheias há regras adicionais por classe de perigo.

  • Novas edificações — inundaçõesEm zonas inundáveis há regras por classe de perigo: em perigo muito alto/alto são em regra proibidos construção e loteamento em solo urbano e rústico; em classes médias e baixas há proibições de caves e regras sobre não colocar quartos de dormir abaixo da cota de cheia, além de exigência de soluções construtivas resistentes à água.(art. 8)

Há muitas limitações que podem impedir ou condicionar obras: RAN/REN, Zonas de proteção hídrica, áreas de património e arqueologia, áreas de risco de inundações e requisitos paisagísticos/ambientais.

  • RAN e RENNos solos da Reserva Agrícola Nacional (RAN) e Reserva Ecológica Nacional (REN) utilizações não agrícolas exigem parecer favorável da Comissão Regional da RAN (RAN) ou da CCDR‑LVT (REN) e aplicam‑se limite acrescidos a terrenos mínimos.(art. 6)
  • Proteção natural e paisagísticaÁreas de proteção a valores naturais impedem em regra o abate de árvores, alterações de relevo, campismo fora das áreas permitidas e colocação de publicidade; só são possíveis usos compatíveis e com projeto licenciado.(art. 7)
  • Linhas de água e albufeirasExistem faixas 'Non Aedificandi' e faixas com jurisdição hidráulica (ex.: 5–10 m em linhas não navegáveis e 10–30 m no Tejo) com proibições e necessidade de licenciamento pela autoridade de hidráulica e proibição de lançamentos sem tratamento.(art. 7)
  • Risco de inundações (ARPSI)A ARPSI tem classes de perigosidade (Muito alta/Alta, Média, Baixa/Muito Baixa) e cada classe traz restrições que podem proibir construção, obras de loteamento, caves, localização de quartos abaixo da cota de cheia e instalação de equipamentos sensíveis.(art. 8)

  • Espécies florestais proibidasÉ em regra interditada a plantação de espécies de rápido crescimento em solos RAN, montado e faixas de proteção e em determinados 20–30 m de nascentes e captações, salvo condições e licenciamento específicos.(art. 6)

  • Estudos hidráulicos e de impactoProjetos de interesse estratégico e infraestruturas em áreas de risco obrigam a estudos hidráulicos detalhados que demonstrem que não aumentam perigo a montante/jusante e que não há alternativa fora da área de risco.(art. 8)
