Definitions and land classification

O regulamento classifica o solo e define categorias que determinam destino e aproveitamento do território.

  • A classificação do solo determina o destino básico dos terrenos, distinguindo solo urbano, solo urbanizado, solo urbanizável e solo rural; a qualificação regula aproveitamentos e parâmetros como a edificabilidade.(art. 24; art. 41)
  • No solo rural definem‑se categorias: Espaços Agrícolas ou Florestais (EAF), Espaços Afetos à Exploração de Recursos Geológicos, Espaços de Ocupação Turística (EOT) e Espaços Naturais (EN) com subcategorias EN1 e EN2.(art. 25; art. 25)
  • No solo urbano existe qualificação que regula o seu aproveitamento e a sua afectação a usos e índices urbanísticos.(art. 24)

Uses and land classes

O regulamento especifica usos admitidos, compatibilidades e proibições por categorias de solo e espaços temáticos.

  • Em solo rural o aproveitamento visa atividades agrícolas, pecuárias, florestais, proteção, lazer e aquicultura, sendo definidas funções de conservação e recreio nos EAF.(art. 24; art. 29)
  • Nos Espaços Naturais EN1 são privilegiadas funções de conservação de habitats, proteção paisagística e recreio; admite‑se recreio sustentável e obras de reconstrução/alteração e ampliações até 250 m2 em condições específicas, sendo proibida construção que não se integre nas funções e alterações morfológicas danosas.(art. 37)
  • No Estuário (EN2) admitem‑se atividades compatíveis com a preservação dos valores naturais, com proibição de atividades que danifiquem valores naturais e alterações morfológicas, salvo para infraestruturas náuticas e similares autorizadas pela Câmara.(art. 38)
  • Em solo urbano são admitidas operações urbanísticas conforme instrumentos (PU, PP, alvará de loteamento) e são vedadas em regra unidades de indústria extrativa, atividades agropecuárias e estaleiros permanentes, salvo locais especificamente destinados.(art. 39; art. 40; art. 41)
  • As categorias Espaços de Atividades Económicas (EAE) incluem subcategorias EAE1 (compatíveis com função residencial), EAE2 (indústria e logística) e EAE3 (indústria transformadora pesada) com usos prioritários e compatibilidades específicas.(art. 46)
  • Espaços de Uso Especial (EUE) integram equipamentos coletivos (EUE1), cultura/recreio (EUE2) e infraestruturas (EUE3), admitindo‑se usos específicos conforme subcategoria.(art. 54; art. 55)
  • Categoria Espaços Verdes (EV) integra áreas de recreio, lazer, desporto e agricultura, com função de equilíbrio ambiental urbano.(art. 52)
  • Espaços de Ocupação Turística (EOT) admitem tipologias compatíveis com o solo rural e estão identificados na Planta de Ordenamento.(art. 34; art. 35)

Building capacity and parameters

O regulamento fixa parâmetros gerais de edificabilidade, alinhamentos, índices e regras específicas por categorias e UOPG, remete para anexos e instrumentos detalhados.

  • A qualificação do solo regula o aproveitamento e o índice de edificabilidade admissível, com parâmetros complementares constantes no Anexo I e em instrumentos (PU, PP, UE); em UOPG/U.E. aplicam‑se parâmetros específicos constantes no Anexo I.(art. 24; art. 82; art. 121)
  • Em solo urbanizado, alinhamentos e altura da fachada/edificação no preenchimento obedecem ao arruamento e ao troço onde se inserem, podendo altura máxima ser superior quando explicitado por instrumento em vigor.(art. 41)
  • Regras para anexos: edifícios anexos em moradias são admissíveis com ocupação máxima de 34 m2 e condições de altura/ocupação e usos, salvo exceções por alvarás anteriores em vigor.(art. 43)
  • Para UOPG indicadas (ex.: UOPG 63, 64, 65, 66) estabelecem‑se índices de edificabilidade específicos, limites de fogos por UE e possibilidade de compensação de áreas destinadas a espaços verdes conforme termo de referência de cada UOPG.(art. 121; art. 51; art. 52)
  • Nos Espaços Naturais e Corredores Estruturantes a EEM define larguras mínimas (ex.: 20 m por margem sempre que os estudos justifiquem) e exigem estudos hidráulicos/hidrológicos para intervenções que afetem leitos e margens.(art. 77; art. 78)

Constraints and easements

O regulamento identifica servidões, zonas de risco, áreas de proteção e requisitos para património e riscos naturais/tecnológicos.

  • Existem servidões e restrições administrativas previstas e identificadas na Planta de Condicionantes e na Carta da REN, incluindo faixas de proteção non aedificandi para redes rodoviárias e ferroviárias e faixas de proteção de infraestruturas básicas.(art. 3; art. 64; art. 74)
  • Áreas suscetíveis a cheias e inundações são cartografadas; o regulamento estabelece normas específicas (construção condicionada, proibição de caves, impermeabilizações e edifícios sensíveis salvo exceções sujeitas a demonstração de cota superior à máxima cheia conhecida e estudos), e exigência de identificação da cota local da máxima cheia para autorizações.(art. 16)
  • Áreas de risco potencial significativo e ARPSI (perigos tecnológicos) estão delimitadas e sujeitas a disciplina específica, incluindo exigência de planos de descontaminação e distâncias mínimas de segurança conforme legislação aplicável.(art. 16-A; art. 20; art. 21)
  • Património cultural imóvel está inventariado com zonas de proteção (normalmente 50 m) e zonas especiais de proteção (ZEP) para equipamentos industriais/classificados, com exigência de pareceres e informação prévia para intervenções em bens inventariados.(art. 10)
  • Corredores ecológicos, Estrutura Ecológica Municipal (EEM) e Reserva Ecológica Nacional/Redes Natura 2000 condicionam usos e exigem salvaguarda das funções ecológicas, com larguras mínimas para margens e necessidade de estudos e medidas de recuperação ambiental.(art. 23; art. 77)

Procedures and execution

O regulamento fixa instrumentos de gestão e execução do plano, procedimentos para operações urbanísticas e exigência de estudos e pareceres em casos específicos.

  • O PDMS é constituído por Regulamento, Planta de Ordenamento e Planta de Condicionantes, acompanhado por estudos (caracterização, relatório ambiental, programa de execução, mapas e fichas) que suportam decisões e procedimentos.(art. 3)
  • Unidades Operativas de Planeamento e Gestão (UOPG) e Unidades de Execução (UE) são os instrumentos de execução, permitindo níveis de planeamento detalhado (PU, PP, UE) e sistemas de execução por cooperação, compensação ou contrato de planeamento/cooperação conforme UOPG.(art. 82; art. 121)
  • Intervenções em património classificado dependem de informação prévia favorável e, quando impliquem intrusão no subsolo, plano de acompanhamento arqueológico e parecer fundamentado da tutela ou serviços municipais; alterações devem minimizar impacto sobre traça e leitura do edifício.(art. 10)
  • Em áreas sujeitas a perigos naturais/ARPSI ou infraestruturas de transporte pode ser exigida elaboração de estudos (estudo de tráfego, estudos hidráulicos/hidrológicos, estudos de desconfinamento/contaminação) e execução de planos de descontaminação ou de acompanhamento.(art. 21; art. 16)
  • Anexos do regulamento (Anexo I a IV) contêm parâmetros urbanísticos, fichas de património e lista de sítios; projetos e operações devem respeitar esses anexos e obter pareceres e autorizações previstas.

Frequently asked questions

Can one build on rustic land in Seixal?

Not automatically. New housing on rustic land is as a rule tightly restricted and, in agricultural or forest classes, often prohibited — unless the Seixal PDM makes an exception (rural settlement, a house tied to a farm, rural tourism, reconstruction of a pre-existence). RAN, REN, protected areas, flood zones or rural fire hazard can still block what the PDM would admit. What can I build on a plot in Seixal?
