Definitions and land classification

O regulamento define a classificação e qualificação do solo em categorias funcionais e subcategorias, e estabelece a distinção entre solo urbano e solo rústico.

Uses and land classes

O regulamento estabelece usos dominantes, compatíveis e complementares por categorias de espaço, com referências específicas a equipamentos, turismo, atividades agroflorestais e industriais.

  • Nos espaços habitacionais a utilização dominante é a habitacional, sendo admissíveis usos complementares como comércio, serviços e equipamentos de utilização coletiva (normas e referências ao Anexo I).(art. 53)
  • No solo rústico são admitidos usos agrícolas, pecuários, florestais e instalações de apoio, incluindo empreendimentos turísticos isolados, equipamentos e infraestruturas para turismo e animação turística, sujeitos a índices e requisitos específicos.(art. 28)
  • Espaços de atividades económicas destinam-se a indústria, armazenagem, logística, comércio e serviços, com possibilidade de uso habitacional excecionalmente e parâmetros próprios (índice de utilização referenciado).(art. 53)

Building capacity and parameters

O regulamento indica parâmetros específicos de edificabilidade (índices, área de intervenção, número máximo de pisos, áreas mínimas e regras para AESRP, NDT e UOPG), condicionando também alinhamentos, alturas e cedências.

  • Para Núcleos de Desenvolvimento Turístico (NDT) fixam-se áreas mínimas, área de intervenção e índices máximos de utilização, capacidade mínima de camas, número máximo de pisos e área máxima de construção conforme escalões (detalhes por escalão no regulamento).(art. 76)
  • Para UOPG (ex.: UOPG 4 — Envolvente do Hospital) são fixados índices e alturas de referência: índice máximo de utilização 0,35, número máximo de pisos 2 (com exceções justificadas) e altura máxima de fachada 7 m (podendo admitir excessos tecnicamente justificados).(art. 77; art. 81)

Constraints and easements

O regulamento integra e refere condicionantes ambientais, patrimoniais e de risco: Estrutura Ecológica, RAN, REN, Rede Natura 2000, Reserva Natural das Lagoas, PIMDFCI e zonas de proteção específicas (albufeiras, dunas).

  • A Estrutura Ecológica Municipal inclui RAN, REN, Reserva Natural das Lagoas de Santo André e da Sancha e Rede Natura 2000 (Zona de Conservação da Costa Sudoeste), condicionando usos e transformações nos solos afetos.(art. 25)
  • Áreas abrangidas pela Rede Natura e PORNLSAS (Comporta/Galé e Costa Sudoeste) estão identificadas na planta de ordenamento e sujeitas a regimes jurídicos específicos, incluindo parecer prévio ou autorizações para diversas intervenções e obras.(art. 11)
  • Património arqueológico e imóveis de interesse municipal estão protegidos por zonas de proteção e procedimentos de prospeção e acompanhamento arqueológico em obras que afetem o subsolo, com obrigação de estudos prévios e pareceres.(art. 18; art. 19)

Procedures and execution

O regulamento detalha procedimentos de execução, instrumentos de planeamento (PU, PP, PIER), execução de NDT e UOPG, e exigências documentais e pareceres para intervenções sensíveis.

  • A execução das operações (nomeadamente NDT) deve ser regulada por contrato de execução que identifique ações, prazos, sistema de execução, mecanismos de perequação e compensações pelo excedente de edificabilidade, conforme estabelecido no programa de execução.(art. 77)
  • UOPG são planeadas e concretizadas por planos de urbanização ou planos de pormenor, com termos de referência específicos (UOPG 1 a 5) que definem objetivos, estudos, parâmetros e instrumentos de execução.(art. 77)
  • Intervenções que afetem o subsolo, em áreas com sítios arqueológicos de nível 2 ou 3 ou num raio de 50 m, exigem estudos arqueológicos prévios, prospeções, acompanhamento arqueológico e pareceres técnica/administrativamente vinculativos; obras suspensas em caso de achados fortuitos.(art. 19)
  • Alterações de uso, operações urbanísticas e licenciamento em áreas sujeitas a regimes de proteção (RN2000, PORNLSAS, RAN/REN) dependem de pareceres favoráveis das entidades competentes e da observância de normas específicas previstas no Anexo I e no regulamento.(art. 11)
