Definitions and land classification

O regulamento define categorias e subcategorias do solo rústico e a composição do PDMLSA e seus elementos cartográficos e documentais.

  • O solo rústico integra categorias e subcategorias como espaços agrícolas (produção fundamental/complementar), espaços florestais (produção/conservação/mistos), espaços de exploração de recursos geológicos (consolidada/salvaguarda/potenciais) e espaços de equipamentos/infraestruturas, identificadas na Planta de Ordenamento.(art. 24)
  • O PDMLSA é constituído por Regulamento, Planta de Ordenamento (com Classificação e Qualificação do Solo, Estrutura Ecológica Municipal, Zonamentos acústicos, etc.), Planta de Condicionantes (Património Natural, Património Classificado, Sistema de Gestão Integrada de Fogos) e vários relatórios e peças técnicas de suporte.(art. 1-O; art. 3)

Uses and land classes

O regulamento discrimina, por categorias de solo e unidades operativas, que ocupações e utilizações são admitidas ou compatíveis, com referências específicas a aglomerados rurais e áreas urbanas.

  • Nos aglomerados rurais do tipo I são admitidos usos como habitação, atividades complementares (comércio, serviços, armazenagem), construções de apoio às atividades agroflorestais, estabelecimentos industriais compatíveis, empreendimentos turísticos e equipamentos coletivos.(art. 68)
  • No solo rústico o regulamento indica, com reserva a regimes legais e condicionantes, que determinadas implantações (p.ex. parques eólicos, fotovoltaicos, ecocentros) só são admitidas conforme as regras específicas e condicionantes previstas.(art. 25)

Building capacity and parameters

O regulamento fixa regimes de edificabilidade por quadro e por unidades operativas, incluindo número de pisos, índices e parâmetros específicos para eixos urbanos relevantes.

  • O Quadro 1 regula condições de edificabilidade em espaços rurais para usos como habitação, instalações agrícolas, apoios florestais, comércio/indústria ligados a atividades rurais e turismo, aplicando-se cota de soleira e a parcela deve cumprir afastamentos do Sistema de Gestão Integrada de Fogos Rurais.(art. 1-A)
  • Para centros urbanos e eixos principais existem parâmetros detalhados (p.ex. Avenida D. Afonso Henriques, Avenida D. Manuel I, Rua de Coimbra) quanto a recuos, número de pisos, altura máxima de fachada, profundidade máxima e regras sobre coberturas e estacionamentos, definidos em artigo próprio.(art. 2-A; art. 128)
  • Edificações legalmente existentes podem ser objeto de manutenção, reconstrução ou ampliação até percentagens e condições específicas, desde que cumpram regimes legais e condicionantes e garantam segurança e salubridade (ampliações até 20–30% em casos referidos).(art. 3; art. 1-S)

Constraints and easements

O regulamento integra e subordina-se a várias condicionantes ambientais, de proteção do património e de risco, e define condicionantes cartográficas na Planta de Condicionantes.

  • Estão identificadas condicionantes relativas a recursos hídricos (domínio hídrico, leitos e margens, captações), proteção de espécies e povoamentos, Rede Natura 2000 (Zona Especial de Conservação da Serra da Lousã) e Sistema de Gestão Integrada de Fogos Rurais (classes de perigosidade, faixas de gestão, rede de pontos de água).(art. 1-P; art. 1-N)
  • As servidões administrativas, restrições de utilidade pública e regimes setoriais prevalecem e condicionam usos e intervenções no solo rústico e urbano, com referências a legislação e instrumentos superiores (PNPOT, Planos Regionais, PNA, Planos de Gestão da Região Hidrográfica).(art. 1; art. 3)

Procedures and execution

O regulamento define instrumentos de gestão, exigência de planos de pormenor ou de urbanização para execução das unidades operativas e condiciona autorizações em função de pareceres e documentos técnicos.

  • A execução das unidades operativas de planeamento e gestão deve ser feita através de Plano de Urbanização ou unidade(s) de execução que cumpram os objetivos programáticos; em ausência destes podem admitir-se operações avulsas desde que integrem o tecido urbano e respeitem os parâmetros definidos.(art. 85; art. 133)
  • Para espaços potencialmente sujeitos a exploração de recursos geológicos e para intervenções em áreas com condicionantes (ex.: inundáveis, inventário natural), aplica-se avaliação e documentação técnica conforme a legislação aplicável e as medidas de salvaguarda constantes no Regulamento.(art. 44)
  • O PDMLSA é acompanhado por relatórios (estudos de caracterização, objetivos e estratégias, avaliação ambiental estratégica e outros) que suportam os procedimentos de decisão e execução previstos no Regulamento.(art. 3)
