Can I build on rustic land in Coimbra?

Municipal cartography does not yet allow a reliable land-classification percentage. The correct reading is the zoning map, the regulation and the overlays (RAN, REN, protected areas, flood zones, rural fire hazard), class by class — and, for a concrete proposal, file a PIP with the Câmara.

Definitions and land classification

Classificação e conceitos técnicos adotados pelo regulamento relativos a solo, tipologias e medidas.

  • O regulamento adota conceitos técnicos do Decreto Regulamentar n.º 5/2019 e define termos como cave, espaço de colmatação, estrutura amovível, frente urbana, índice de edificabilidade, número de pisos e superfície de pavimento (com exclusões específicas).(art. 5)
  • O solo é classificado em solo rústico e solo urbano, com categorias e subcategorias detalhadas para cada um (ex.: espaços agrícolas, florestais, espaços centrais C1–C3, áreas habitacionais H1–H4, AE1/AE2, espaços verdes, áreas de equipamento, infraestruturas e turismo).(art. 22; art. 23; art. 24)

Uses and land classes

O regulamento especifica usos dominantes, complementares e compatíveis por categorias de solo, e disciplina usos especiais, infraestruturas e atividades específicas.

  • Usos dominantes, complementares e compatíveis são tipificados para cada categoria/subcategoria (ex.: espaços agrícolas: produção agrícola e pecuária; espaços florestais: uso florestal; espaços centrais: habitação, comércio, serviços e equipamentos).(art. 25; art. 40; art. 43; art. 85)
  • Usos especiais (infraestruturas, centrais de energia renovável, exploração geológica, depósitos, armazenagem de combustíveis e postos de abastecimento) podem ser admitidos conforme condições e condicionamentos específicos do regulamento e da legislação aplicável.(art. 32; art. 33; art. 34; art. 35; art. 36; art. 37)

Building capacity and parameters

O regulamento estabelece índices, alturas, números de pisos, áreas máximas e índices de impermeabilização específicos por categorias e casos especiais.

  • Parâmetros gerais por áreas centrais e habitacionais: índices e número de pisos para C2/C3 e H1–H4, com faixas de 25 m e percentuais de ultrapassagem até 20% mediante créditos de construção; índices de impermeabilização associados.(art. 89; art. 92; art. 94)
  • Em aglomerados rurais e tipologias rurais: índices de edificabilidade (ex.: 0,70 na faixa de 25 m para aglomerados), número de pisos, índices de impermeabilização e superfícies máximas conforme tipologia (habitação: lotes mínimos, 300 m2 Sp; construções de apoio e instalações pecuárias: índice 0,10 e altura 7 m; industriais e outros com índices e áreas próprios).(art. 53; art. 67; art. 68; art. 69; art. 72)
  • Áreas específicas: AE1 (índice 0,40 e áreas verdes mín. 30%); AE2 (índice volumétrico 7,5 m3/m2, impermeabilização 0,80, altura 15 m), área aeronáutica (índice 0,45 e altura fachada 9 m), UOPG com índices próprios (ex.: UOPG3 index 0,3; UOPG4 index 0,5).(art. 98; art. 101; art. 65; art. 145)
  • Edificabilidade para infraestruturas e equipamentos deve ser a estritamente exigida pela sua natureza funcional, podendo unidades operativas e anexos definir parâmetros adicionais.(art. 31; art. 110)

Constraints and easements

O regulamento identifica servidões, reservas e áreas protegidas, bem como riscos naturais e condicionamentos específicos que condicionam usos e obras.

  • Servidões administrativas e restrições de utilidade pública (domínio hídrico, RAN, REN, áreas protegidas, património edificado, infraestruturas rodoviárias e ferroviárias, rede elétrica, gasodutos, telecomunicações, etc.) são observadas e representadas na Planta de Condicionantes, condicionando uso/ocupação em conformidade com as disposições vinculativas em vigor.(art. 6; art. 7)
  • Estrutura ecológica municipal: áreas identificadas com restrições específicas (proibições de aterros/escavações, derrube sistemático de árvores, artificialização de linhas de drenagem, proibição de eucalipto/ailantos em rearborização), salvo exceções para projetos hidroagrícolas.(art. 8; art. 9)
  • Risco hídrico e movimentos de massa: em zonas inundáveis as cotas de pisos devem ser superiores à cota da máxima cheia conhecida, pavimentação permeável e restrições a novos equipamentos coletivos; em áreas suscetíveis de movimentos de massa exigem-se demonstrações de não provocarem movimentos ou medidas de mitigação em solo urbano.(art. 12; art. 13)
  • Património (Centro Histórico, sítios arqueológicos, bens classificados): intervenções sujeitas a medidas de proteção/valorização, avaliação de impacte arqueológico prévia em revolvimento do solo e regulação municipal específica para a área classificada pela Unesco.(art. 15; art. 16; art. 17; art. 18; art. 19)
  • Salvaguardas a infraestruturas de saneamento e aeroportuárias: faixas non aedificandi e restrições de usos/plantação junto a reservatórios, adutoras e ETAR; servidões aeronáuticas do Aeródromo Bissaya Barreto com superfícies limitativas de obstáculos e áreas proibidas/condicionadas (Anexo I).(art. 20; art. 21)
  • Risco de incêndio rural condiciona edificabilidade fora das áreas edificadas consolidadas, com cartografia de perigosidade e exigência de faixas de proteção e parecer da CMDFCI para novas edificações/ampliações.(art. 29)

Procedures and execution

O regulamento define instrumentos e formas de execução do plano, conteúdos e condicionamentos procedimentais.

  • O PDM integra regulamento, plantas de ordenamento e condicionantes e é acompanhado por estudos, relatórios ambientais, programas de execução, mapas e fichas técnicas obrigatórias para a implementação.(art. 3)
  • Instrumentos de gestão territorial a observar são elencados (PNPOT, planos sectoriais e regionais, planos de pormenor existentes) e alguns planos de pormenor prevalecem sobre o PDMC; planos setoriais vinculam diretamente particulares em matérias florestais.(art. 4)
  • Execução e programação: em solo urbano a execução processa-se dominantemente por operações previstas no Regime Jurídico de Urbanização e Edificação; prevê-se sistema de incentivos, programas estratégicos e operacionais, UOPG como unidades de execução e planos de urbanização/pormenor e contratos de execução para núcleos turísticos.(art. 134; art. 136; art. 139; art. 79; art. 145)
  • Unidades Operativas de Planeamento e Gestão (UOPG) são identificadas e delimitadas no Anexo VII e sujeitas a formas de execução específicas (planos de urbanização, pormenor, unidades de execução), com objetivos e parâmetros próprios.(art. 145)

Frequently asked questions

Can one build on rustic land in Coimbra?

Not automatically. New housing on rustic land is as a rule tightly restricted and, in agricultural or forest classes, often prohibited — unless the Coimbra PDM makes an exception (rural settlement, a house tied to a farm, rural tourism, reconstruction of a pre-existence). RAN, REN, protected areas, flood zones or rural fire hazard can still block what the PDM would admit. A listing that says “construction is possible” does not replace the map or a PIP at the Câmara Municipal.

Is this PDM in force?

The operativity shown here comes from the ingested legal instrument, not from the status of a revision procedure. Always confirm in the official source.

How does one know the class of a specific plot?

These pages describe the concelho. The caderneta predial is not enough: «prédio rústico» in the tax register is not «solo rústico» in the PDM. Use Explore with the exact point, cross it with the regulation and, for a concrete proposal, file a PIP with the Câmara Municipal of Coimbra.

What can I build on a plot in Coimbra?

It depends on the plot's land class on the zoning map and on the rules in the Coimbra PDM regulation. On urban land, housing and other uses are admitted within the class parameters (area, height, setbacks, indices). On rustic land the use is more restricted and new housing is often conditional or prohibited. Only reading the specific plot on the map, cross-checked with the regulation and the constraints, confirms what is possible.

How much can I build on a plot in Coimbra?

Building capacity — floor-area and site-coverage indices, height and setbacks — is set by the PDM regulation for the plot's land class. These pages show the per-class parameters where confirmed; for a specific plot those values are confirmed on the map and in the regulation and, formally, through a pedido de informação prévia (PIP) to the Coimbra Câmara.

What is the difference between urban and rustic land in Coimbra?

Urban land is meant for urbanisation and building; rustic land protects agricultural, forest, natural or risk uses, and building is exceptional. A plot may be either in the PDM, regardless of what the caderneta predial says. The concrete class is read from the zoning map, not the tax register.

What are the most common constraints in Coimbra?

The constraints with most weight are the National Agricultural Reserve (RAN), the National Ecological Reserve (REN), Natura 2000 areas, flood zones and rural fire hazard. How do I file a pedido de informação prévia (PIP) with the Coimbra Câmara?

The PIP is filed with the Câmara Municipal of Coimbra, as a rule at the urbanism desk or the municipal portal, identifying the property and describing the proposal. The reply states whether the works are viable and under which parameters. It is the formal way to confirm what can be built before committing to a deal or a project.

Can I legalise or rebuild a house on rustic land in Coimbra?

A building with proven legal existence may, depending on the Coimbra PDM, be rehabilitated or reconstructed under conditions sometimes more accessible than a wholly new build. Legalising works without a permit depends on the regulation and the applicable constraints. Always confirm with the Câmara, preferably through a PIP.

How is rustic land reclassified as urban in Coimbra?

Reclassifying rustic land as urban is a decision of the Câmara Municipal within the plan, subject to strict RJIGT conditions (since 2025, as a rule contiguity with urban land and an affordable or public-housing component). It is not a landowner's right, nor is it obtained through an individual building request.
