Can I build on rustic land in Góis?

About 98% of the territory of Góis is rustic land. That does not mean one may never build, but new housing is as a rule tightly restricted and often prohibited unless the PDM makes an exception (rural settlement, a farmhouse, reconstruction). RAN, REN, protected areas, flood zones or rural fire hazard can still block what the plan would admit. Definitions and land classification

O regulamento define classes de solo e conceitos operacionais usados no PDM, distinguindo solo urbano e solo rústico e várias subcategorias em função da utilização dominante.

  • Classificação do solo em solo urbano e solo rústico, com subcategorias do solo rústico (espaços agrícolas de produção, outros espaços agrícolas, espaços florestais de produção, produção condicionada, proteção, espaços de atividade industrial, equipamentos/infraestruturas e aglomerados rurais) e do solo urbano (espaços centrais, habitacionais, etc.).(art. 30)

Uses and land classes

O regulamento especifica usos admissíveis por classes de espaço, com listas e condicionamentos específicos para solo urbano, solo rústico, espaços agrícolas, florestais, atividades económicas, equipamentos, verdes e aglomerados rurais.

  • Nos espaços centrais admitem-se habitação, comércio, serviços, equipamentos coletivos, empreendimentos turísticos e armazéns conforme legislação específica.(art. 63)
  • Nos espaços habitacionais admitem-se funções residenciais, comércio e serviços complementares, anexos de apoio e pequenas atividades compatíveis.(art. 66)
  • Nos espaços de atividades económicas são admitidos estabelecimentos industriais, armazéns, comércio por grosso/retalho, oficinas, instalações de gestão de resíduos e apoio ao pessoal de segurança.(art. 72)
  • No solo rústico admitem-se estabelecimentos hoteleiros, empreendimentos turísticos (incluindo parques de campismo), e atividades ligadas à agricultura, pecuária e floresta, com condicionalismos e regras próprias.(art. 39; art. 46)
  • Espaços agrícolas e florestais admitem instalações de comércio/serviços ligados à atividade agrícola e florestal, anexos, e empreendimentos turísticos sujeitos a limites de parcela, cércea e índices.(art. 92; art. 93)
  • Aglomerados rurais permitem habitação, anexos, instalações adstritas à atividade agrícola, atividade pecuária (até classe 3), equipamentos coletivos, empreendimentos turísticos nas tipologias permitidas e pequenas indústrias/serviços compatíveis.(art. 58)

Building capacity and parameters

O regulamento estabelece parâmetros de edificabilidade (índices de utilização/ocupação, impermeabilização, alturas, número de pisos, áreas mínimas e limites por tipologia e categoria de espaço) que variam conforme a classe de solo.

  • Parâmetros gerais: índices de ocupação/uso e impermeabilização máximos variam por espaços (ex.: EAE IO máximo 80%, impermeabilização 90%; espaços de equipamentos IU máximo 0,6).(art. 73; art. 76)

Constraints and easements

O regulamento refere condicionantes de proteção ambiental, riscos, património, captações de água e servidões que influenciam usos e intervenções no território.

  • Identificação e proteção do património imaterial e imóvel classificado, com zonas especiais de proteção e exigência de consulta às tutela(s) para intervenções.(art. 6; art. 28)
  • Existem zonas de proteção e servidões (por ex. zona de proteção da albufeira do Cabril com zona reservada de 50 m e faixas específicas com proibições e condicionamentos).(art. 88; art. 89)
  • Proteção de captações de água com zonas de proteção imediata onde são interditas determinadas atividades e exigido manter zonas limpas e sem poluição.(art. 8)
  • Zonamento acústico e áreas de risco ao uso, Reserva Ecológica Nacional e Reserva Agrícola Nacional e perigosidade de risco de incêndio constam da planta de condicionantes e são aplicáveis segundo a planta.(art. 3; art. 12)
  • Regras de gestão e execução em perímetros de regadio e sistemas hidráulicos sujeitas a prévia aprovação e orientações técnicas da Direção Regional da Agricultura.(art. 10)

Procedures and execution

O regulamento prevê instrumentos e procedimentos de execução do PDM, incluindo UOPG, unidades de execução, contratos para núcleos turísticos e requisitos para legalizações e licenciamento.

  • Identificação de Unidades Operativas de Planeamento e Gestão (UOPG) na planta e possibilidade de delimitação de Unidades de Execução para gestão integrada e reabilitação urbana.(art. 81; art. 83)
  • Execução em solo urbano sujeita ao regime de operações urbanísticas previstas no PDM; a Câmara pode delimitar unidades de execução e aplicar mecanismos de perequação e cedências.(art. 82; art. 85; art. 86)
  • Núcleos de desenvolvimento turístico exigem prévia celebração de contrato de execução com identificação de ações, prazos, medidas compensatórias e quadro de sanções; propostas programáticas e pareceres técnicos são exigidos para empreendimentos de interesse.(art. 42; art. 34)
  • Legalização de preexistências e instalações (incluindo agropecuárias) sujeita a verificação documental, vistoria, requisitos de ligação a sistemas de tratamento e limites de ampliação até 30% em certos casos.(art. 36)

Can one build on rustic land in Góis?

Not automatically. New housing on rustic land is as a rule tightly restricted and, in agricultural or forest classes, often prohibited — unless the Góis PDM makes an exception (rural settlement, a house tied to a farm, rural tourism, reconstruction of a pre-existence). RAN, REN, protected areas, flood zones or rural fire hazard can still block what the PDM would admit. A listing that says “construction is possible” does not replace the map or a PIP at the Câmara Municipal.

What can I build on a plot in Góis?

It depends on the plot's land class on the zoning map and on the rules in the Góis PDM regulation.
