Can I build on rustic land in Mira?

About 85% of the territory of Mira is rustic land. That does not mean one may never build, but new housing is as a rule tightly restricted and often prohibited unless the PDM makes an exception (rural settlement, a farmhouse, reconstruction). O regulamento classifica o solo em urbano e rústico e qualifica subcategorias para cada um, com categorias específicas para espaços naturais, agrícolas, florestais, industriais, equipamentos e turismo.

Uses and land classes

O regulamento especifica usos admissíveis e compatíveis por categorias de solo, incluindo listas para espaços naturais, agrícolas, florestais, turísticos, industriais, equipamentos e espaços urbanos.

  • Em solo rústico admitem-se estufas, apoios a atividades agrícolas, habitação do agricultor (cumprindo condições), equipamentos de utilização coletiva e, quando compatíveis, empreendimentos turísticos isolados e parques temáticos (Artigos 11.º, 23.º, 24.º).(art. 11; art. 24)
  • Espaços destinados a Equipamentos e Uso Especial — Turismo admitem equipamentos coletivos, infraestruturas turísticas e, excecionalmente, habitação do promotor sob condições (Artigos 33.º, 52.º–54.º).(art. 54)
  • Empreendimentos turísticos isolados e núcleos de desenvolvimento turístico admitem tipologias como hotéis, TER, TH, parques de campismo e devem demonstrar compatibilidade ambiental e urbana (Artigos 13.º–16.º).(art. 13)

O regulamento fixa índices e parâmetros diferenciados por categorias de solo — ocupação, impermeabilização, utilização, alturas e número de pisos — aplicáveis com exceções e condicionamentos específicos.

O regulamento integra várias servidões, reservas e zonas de risco que condicionam usos e edificações, incluindo RAN, REN, Rede Natura, faixas costeiras, zonas inundáveis e faixas non aedificandi sob rodovias.

O regulamento fixa procedimentos para execução do plano, unidades operativas de planeamento e gestão (UOPG), instrumentos de execução, contratos de execução para NDT e regras de regularização e legalização.
