Uses and land classes

O regulamento define usos dominantes e complementares por categorias de espaços, e especifica limitações em zonas de risco (inundação, incêndio) e em áreas de infraestrutura e serviços.

  • O sistema ambiental integra zonas inundáveis, risco de incêndio e zonamento acústico, condicionando usos e ações nessas áreas.(art. 8)
  • Em zonas inundáveis são proibidas, em regra, novas construções que obstruam a circulação das águas, sendo admitidas exceções listadas (substituições licenciadas, ampliações restritas, equipamentos de apoio e obras de acessibilidade), e são proíbidos usos sensíveis (saúde, escolares, lares), caves, criação de novas unidades funcionais e aterros quando aumentem o risco.(art. 8)
  • Os espaços de uso especial e outros espaços municipais têm usos dominantes e complementares definidos por categoria, com equipamentos de apoio admitidos quando compatíveis com a função principal.(art. 49)

O regulamento estabelece regimes de edificabilidade diferenciados por categorias e UOPG, com parâmetros de ocupação, impermeabilização e índices específicos conforme o capítulo da categoria de solo.

  • Para alguns espaços (ex.: Espaços de Uso Especial) são indicados índices máximos de ocupação do solo e de impermeabilização, e demais parâmetros a observar nas operações urbanísticas.(art. 49; art. 73)
  • Nas UOPG podem ser substituídos os parâmetros abstratos do PDM por parâmetros urbanísticos precisos que definam a edificabilidade aplicável à execução.(art. 104)

O Plano identifica servidões, restrições e áreas protegidas que condicionam intervenções (recursos hídricos, reservas agrícolas, REN, RAN, risco de incêndio e redes de defesa, património).

Procedures and execution

O regulamento prevê procedimentos para legalização, regularização, execução por UOPG/Unidades de Execução e procedimentos de apreciação técnica e condicionamento prévio.

  • Existem procedimentos especiais para regularização de preexistências e atividades económicas, com prazos e condicionantes e possibilidade de parecer favorável condicionado mediante cumprimento de condições cumulativas.(art. 32; art. 35; art. 36)
  • A execução do Plano em áreas complexas é feita por UOPG ou Unidades de Execução, que demarcam espaços e definem conteúdo e formas de intervenção, e cuja aprovação pode substituir parâmetros do PDM; a execução deve respeitar prazos de financiamento e programa de execução.(art. 104; art. 95)
  • Nas intervenções em zonas inundáveis são exigidos controlos prévios, demonstração da inexistência de alternativas, medidas de mitigação (elevação de cota do piso, proteção), e menção obrigatória da inclusão do edifício no registo de risco quando aplicável.(art. 8)
