Uses and land classes

O regulamento enumera usos admitidos por categorias de solo (especialmente espaços agrícolas de produção e complementares, aglomerados rurais e áreas dispersas), condicionando tipologias conforme a função dominante e regimes específicos.

  • Nos espaços agrícolas de produção são admitidas construções de apoio agrícola, habitação de residência própria, atividades equestres, obras hidráulicas e infraestruturas públicas, bem como empreendimentos turísticos complementares à atividade agrícola (quando compatíveis) — o regulamento detalha usos admitidos e legalizações possíveis.(art. 12)
  • Em aglomerados rurais e áreas de edificação dispersa são previstos usos com algumas funções urbanas e de apoio local, favorecendo-se a consolidação progressiva mediante parâmetros próprios, admitindo-se habitação, apoio agrícola e empreendimentos turísticos segundo as regras da respetiva secção.(art. 38; art. 42)
  • Operações de loteamento e edificações constituídas anteriores à vigência do PDM mantêm usos admitidos nos respetivos alvarás, com regras específicas para legalização e para parâmetros urbanísticos aplicáveis.(art. 6)

Building capacity and parameters

O regulamento fixa parâmetros por tipologia e categoria de solo: áreas mínimas de parcela, áreas máximas de construção, índices de ocupação/uso do solo, alturas máximas de fachada e afastamentos, com variações consoante espaços (agrícolas, rurais, dispersos, turísticos).

  • Para edificações destinadas a habitação em determinados contextos aplicam-se áreas mínimas de parcela (ex.: 40.000m2 ou 5.000m2 conforme secção), número de fogos por parcela e área total máxima de construção (por exemplo 300m2 em várias disposições), com altura máxima de fachada frequentemente 6,5m — o regulamento prevê exceções para reconstrução em edificações legalmente existentes.(art. 13; art. 39; art. 38)
  • Edificações de apoio à atividade agrícola têm índices e alturas definidas (ex.: índice de ocupação 0,03 em espaços agrícolas complementares; 0,05 em aglomerados rurais ou 0,05/0,03 consoante a secção) e alturas máximas de fachada até 8m salvo especificidade técnica.(art. 13; art. 38; art. 42)
  • São definidos afastamentos mínimos (ex.: 5m às extremas da parcela em várias tipologias; 50m dos limites do prédio para classes 1 e 2 em explorações; 10m para pequenas explorações/classe 3), criação de cortinas arbóreas e proibições/condições para muros e pavimentos, e limites relativos à impermeabilização e áreas livres intersticiais.(art. 13; art. 17; art. 39)
  • Para empreendimentos turísticos e estabelecimentos indica-se área mínima de parcela e área total máxima de construção por tipologia (por exemplo 20.000m2 parcela mínima nalgumas disposições e 2.000m2 máximos noutros), com possibilidade de integração por PP ou NDT conforme artigo específico.(art. 13; art. 39; art. 36)

Constraints and easements

O regulamento integra servidões administrativas, restrições e áreas protegidas (RAN, REN, Rede Natura/SIC, ZMP/ZTP, faixas de salvaguarda costeira, zonas de risco e património), condicionando usos e procedimentos nas respetivas áreas.

  • Identificam‑se servidões e recursos naturais como RAN, REN, Rede Natura 2000/ ZEC Sintra‑Cascais, domínio hídrico (leitos e margens), perímetros de recursos geológicos e perigosidade de incêndio, com as respetivas restrições de uso e normas aplicáveis.(art. 6; art. 9)
  • Em áreas integradas em regimes de proteção (ex.: SIC Sintra‑Cascais, ZMP/ZTP), prevalecem normas adicionais e podem ser exigidos pareceres e avaliações de impacte; a faixa de proteção costeira e de salvaguarda tem ações interditas e exceções especificadas.(art. 10; art. 67; art. 68)
  • Zonas de risco (instabilidade de vertentes, erosão, risco tecnológico), patrimonial (núcleos de quintas, património municipal) e zonas de conflito acústico são identificadas e sujeitas a regimes específicos que condicionam ocupação e edificação.(art. 77; art. 83; art. 86)

Procedures and execution

O regulamento prevê instrumentos de gestão (UOPG/SUOPG, PU, PP), com requisitos para execução, programação e comissões consultivas, exigindo documentos e pareceres conforme a área e condicionantes.

  • Unidades Operativas de Planeamento e Gestão (UOPG) e Subunidades (SUOPG) são definidas no anexo V; os PU, PP ou unidades de execução devem respeitar objetivos e orientações específicas e prevalecerão sobre disposições gerais quando aprovados.(art. 106; art. 118)
  • A elaboração de instrumentos de detalhe (PU/PP) pode alterar limites e categorias mediante justificação e deve atender às orientações específicas, incluindo planos de gestão para UOPG sujeitas a habitats/espécies; até então aplicam‑se os parâmetros de solo definidos nos capítulos IV e V.(art. 120; art. 122)
  • A câmara pode constituir comissões consultivas de técnicos e entidades para recolha de pareceres sobre urbanismo, paisagem, património, ambiente e floresta; projetos em áreas sensíveis podem exigir avaliação de impacte e pareceres de entidades competentes.(art. 7; art. 10)
  • Operações de loteamento anteriores mantêm alvarás aplicáveis, sendo os usos e parâmetros do alvará prevalecentes salvo omissão, e admitindo‑se compra de terrenos para realizar cedências previstas no regime de execução e compensações (fundo de compensação e perequação previstos).(art. 115; art. 116)

Frequently asked questions

Can one build on rustic land in Mafra?

Not automatically. New housing on rustic land is as a rule tightly restricted and, in agricultural or forest classes, often prohibited — unless the Mafra PDM makes an exception (rural settlement, a house tied to a farm, rural tourism, reconstruction of a pre-existence). RAN, REN, protected areas, flood zones or rural fire hazard can still block what the PDM would admit. A listing that says “construction is possible” does not replace the map or a PIP at the Câmara Municipal.

Is this PDM in force?

How does one know the class of a specific plot?

These pages describe the concelho. The caderneta predial is not enough: «prédio rústico» in the tax register is not «solo rústico» in the PDM. Use Explore with the exact point, cross it with the regulation and, for a concrete proposal, file a PIP with the Câmara Municipal of Mafra.

What can I build on a plot in Mafra?

It depends on the plot's land class on the zoning map and on the rules in the Mafra PDM regulation. On urban land, housing and other uses are admitted within the class parameters (area, height, setbacks, indices). On rustic land the use is more restricted and new housing is often conditional or prohibited. Only reading the specific plot on the map, cross-checked with the regulation and the constraints, confirms what is possible.

How much can I build on a plot in Mafra?

Building capacity — floor-area and site-coverage indices, height and setbacks — is set by the PDM regulation for the plot's land class. These pages show the per-class parameters where confirmed; for a specific plot those values are confirmed on the map and in the regulation and, formally, through a pedido de informação prévia (PIP) to the Mafra Câmara.

What is the difference between urban and rustic land in Mafra?

Urban land is meant for urbanisation and building; rustic land protects agricultural, forest, natural or risk uses, and building is exceptional. A plot may be either in the PDM, regardless of what the caderneta predial says. The concrete class is read from the zoning map, not the tax register.

What are the most common constraints in Mafra?

Can I legalise or rebuild a house on rustic land in Mafra?

A building with proven legal existence may, depending on the Mafra PDM, be rehabilitated or reconstructed under conditions sometimes more accessible than a wholly new build. Legalising works without a permit depends on the regulation and the applicable constraints. Always confirm with the Câmara, preferably through a PIP.

How is rustic land reclassified as urban in Mafra?

Reclassifying rustic land as urban is a decision of the Câmara Municipal within the plan, subject to strict RJIGT conditions (since 2025, as a rule contiguity with urban land and an affordable or public-housing component). It is not a landowner's right, nor is it obtained through an individual building request.
