Definitions and land classification

O regulamento define conceitos e classifica o solo em categorias de solo urbano e rural e respetivas subcategorias, além de conceitos técnicos de edificação e índices urbanísticos.

Uses and land classes

O regulamento estabelece usos dominantes e preferenciais por classes de solo e enumera proibições e compatibilidades específicas em várias categorias (urbanas, industriais, turísticas, ecológicas e agrícolas).

  • Em verde ecológico urbano permitem‑se atividades socioculturais, recreio e desporto, com construção limitada e condicionada a estudos específicos.(art. 40; art. 41)
  • Espaços agrícolas e agro‑florestais regulam usos agrícolas e florestais; permitem‑se obras de apoio, habitação agrícola e turismo rural conforme condições e afastamentos.(art. 43; art. 45)

Building capacity and parameters

O regulamento fixa parâmetros de edificabilidade, alturas, índices e áreas máximas em função das classes de solo e de unidades operativas, além de afastamentos e limites para tipologias específicas.

  • Áreas industriais: altura máxima 12 m (exceções para torres/chaminés), índice de implantação bruto máximo 0,50, afastamentos mínimos frente/tardoz 10 m, laterais 5 m; faixas de proteção mínimas interiores de 25 m com 60% em cortina arbórea.(art. 26)
  • Áreas de verde ecológico urbano: índice máximo de construção 0,002 da parcela até 150 m2 de área bruta de construção; recuperações habitacionais até 250 m2 e edifícios de apoio até 50 m2.(art. 40)
  • Áreas agrícolas especiais (quando integradas na RAN): parcela mínima 40.000 m2, máximo de 1 fogo, cércea máxima 7 m, habitação bruta máxima 400 m2 e anexos agrícolas 400 m2 (com exceções técnicas), afastamento mínimo 20 m.(art. 44)
  • Áreas agro‑florestais: para habitação parcela mínima 40.000 m2, 1 fogo, cércea 7 m, índice bruto de construção máximo para habitação 0,01 e para anexos 0,01; edificações de apoio índice 0,005 (salvo exceções técnicas).(art. 46)
  • Áreas de edificação dispersa: parcela mínima 500 m2, 1 fogo, máximo 2 pisos acima da cota média, cércea 7 m, área bruta máxima 250 m2 para habitação e 350 m2 para anexos agrícolas.(art. 47)
  • UOPG e parâmetros turísticos: UOPG10 — camas max. 300, índice implantação 0,10, pisos hoteleiros max. 3, cércea 7 m, meios complementares 30%; UOPG18 — 31 camas/ha até 2500 camas, índice implantação 0,08, índice construção 0,15, pisos hoteleiros 3, cércea moradias 7,5 m e moradias/apartamentos 10 m, meios complementares 85%.(art. 112; art. 120)

Constraints and easements

O regulamento identifica servidões, condicionamentos ambientais, de infra‑estruturas e de património, e fixa zonas de salvaguarda e proibições específicas para áreas sensíveis.

  • Enumera servidões e restrições de utilidade pública relativas à conservação do património natural (linhas de água, zonas inundáveis, captações, REN, RAN, Rede Natura, montados, árvores de interesse) e património edificado/arqueológico.(art. 5)
  • Protecção de infra‑estruturas e equipamentos (redes de saneamento/abastecimento, linhas de alta tensão, oleodutos/gasodutos, redes viárias, ferrovia, aeroportos, telecomunicações) e cartografia de marcos geodésicos.(art. 5)

  • Zonas inundáveis: proibição de construções em cave nas áreas urbanas/urbanizáveis; pisos térreos abaixo da maior cheia conhecidos com utilização condicionada (estacionamento ou usos que não constituam barreiras à circulação das águas); proibição de alterações de uso para habitação/comércio nesses pisos.(art. 15)
  • Áreas de protecção integral e áreas naturais de valor paisagístico com numerosas interdições (obras novas, acções que comprometam paisagem, estufas/abrigos, explorações mineiras, antenas), e salvaguardas para edificações existentes com limites de ampliação.(art. 53; art. 54)
  • Áreas de salvaguarda do património com área envolvente até 50 m e proibição de intervenções que prejudiquem os elementos protegidos; requisitos específicos para moinhos e fortes.(art. 66)

Procedures and execution

O regulamento define documentos do PDM, instrumentos de gestão territorial, UOPG, sistemas de execução e regras de licenciamento, expropriação e perequação para execução do plano.

Can one build on rustic land in Torres Vedras?

Not automatically. New housing on rustic land is as a rule tightly restricted and, in agricultural or forest classes, often prohibited — unless the Torres Vedras PDM makes an exception (rural settlement, a house tied to a farm, rural tourism, reconstruction of a pre-existence). RAN, REN, protected areas, flood zones or rural fire hazard can still block what the PDM would admit. A listing that says “construction is possible” does not replace the map or a PIP at the Câmara Municipal.
